HomeMy WebLinkAboutCity of Tamarac Ordinance O-1970-015• ORDINANCE NO. 70 - 15 AN ORDINANCE REGULATING THE DISPOSAL AND PICKUP OF GARBAGE, TRASH AND MATTERS OF SIMILAR IMPORT, APPLYING SEPARATE PROCEDURE TO RESIDENTIAL AND COMMERCIAL AREAS WITHIN THE CITY; PROHIBITING GENERAL LITTERING; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY THEREFOR; REPEALING ALL ORDINANCES IN CONFLICT THEREWITH; AND FOR OTHER PURPOSES. WHEREAS, the Council of the City of Tamarac deems it wise and expedient and in the best interest of the health, wel- fare and safety of the citizenry of the City of Tamarac to regulate the storage, accumulation and disposal of garbage, trash and matters of similar import; now, therefore, 0 FLORIDA: BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, SECTION 1: Definitions. For the purpose of this article the following words and terms are defined. 1. Garbage shall include all kitchen and table refuse, all general combustible waste, paste- board boxes, accumulation of animal or vege- table matter which attends to the preparation, use, cooking, processing, handling or storage of meats, fish, fowl, fruits, vegetables and other matter which is subject to decomposition, decay, putrefaction or the generation of noxious or offensive gases or odors, which during or after decay, may serve as breeding or breeding material for flies, insects or animals. 2. Trash shall mean every waste, accumulation or deposit of paper, sweepings, dust, rags, bottles, cans and other matter of any substance or kind, including but not necessarily limited to sub- stantive compositions of paper, wood, metal, • • 0 ORDINANCE NO. 70 - /2� (Continued) -2- brick, glass, and matters of similar import and composition; and specifically including such matters as refrigerators and stoves, paper cups, bottle caps, beverage cans and all types of paper and construction debris. 3. Yard trash means every waste accumulation of Lawn., grass or shrubbery cutting or clippings and dry leaf Takings, rocks, branches, palm fronds, tree branches, parts of trees, bushes or shrubs, green leaf cuttings, coconuts, fruit or other matter, usually created as refuse in the care of trees or large bushes. SECTION 2: Garbage Receptacles - Residences. There shall be kept and maintained in or at all residences and apartment houses adequate receptacles in which . garbage shall be placed and stored in order that such garbage may be collected. Garbage receptacles shall be of sufficient size to meet normal requirements of collection. Such recep- tacles shall be kept in a place easily accessible to the gar- bage collector, but never upon any street or sidewalk. 0 SECTION 3: Garbage Receptacles - Commercial Uses. All boarding house keepers, butchers, hotels, restaurants, dining rooms, grocery stores, or any other public place where garbage may accumulate shall provide for the storage of such garbage in a water tight, metal receptacle provided with handles and a tight fitting metal cover. Such cans shall be kept in a place easily accessible to the garbage collector, but never upon any street or sidewalk. Such receptacle shall be thoroughly cleaned by the owner after it has been emptied by the garb)aage collector. SECTION 4• Moist Garbage to be Wrapped. All garbage or debris which might contain any moisture, whatsoever, shall first be wrapped in paper before being placed in the garbage receptacle. ORDINANCE NO. 70 - (Continued) -3- SECTION 5: Accumulation Declared Nuisance. r� U U� Any unauthorized accumulation of garbage or trash on any street, sidewalk, alley or other public place or property, or upon any private property, or any accumulation of stagnant water or a dense growth of trees, vines and underbrush on any property within the City is hereby declared to be a nuisance. SECTION 6: Accumulation Prohibited. A. No person shall place, throw or otherwise deposit any garbage or trash on any street, sidewalk, alley or other public place or property, or upon private property, whether owned by such person or not, and no person who is the owner of private property, and no person who is in possession of private property shall permit any garbage or trash to be placed or stored upon any such property, unless the same is authorized by ordinance, or has been previously specially authorized by the City Clerk for collection purposes. B. No person owning or having possession of any land within the City shall allow the accumulation of stagnant water or the development of a dense growth of trees, vines or underbrush thereon. SECTION 7: No person shall place, throw or deposit, any item defined in Section 1 above, upon any public or private place, other than in a duly constituted receptacle. SECTION 8: No person shall ignite, cause to be ignited, or allow any burning of substances defined in paragraphs 1, 2 and 3 of Section I above, upon any public or private place without obtaining a permit from the Building Department in the City of Tamarac prior to igniting said substances. No permit shall be issued by the Building Department unless it is shown that said substances are non -explosive, to be burned in a place where spreading will not occur and that the substances are of such quality and quantity as to not go out of control. Addi- tionally, the applicant shall have, at the place of the burning, U ORDINANCE NO. 70 - 6 (Continued) -4- sufficient fire extinguishing facilities to divert any accidental spreading. The Chief Building Inspector shall issue said permit upon the applicant's compliance with the foregoing, and payment of $ a O .(�en l3OaWLO,) SECTION 9: Any person found guilty of violating the provisions of this ordinance in the Municipal Court of the City of Tamarac may be fined by a fine not exceeding Five Hundred Dollars ($500.00), or imprisonment for a term not exceeding ninety (90) days, or by both such fine or imprisonment, Each day any violation of any section of this code occurs shall con- stitute a separate offense; provided, however, the minimum fine imposed shall be in accordance with the following: first offense Twenty-five ($25.00) Dollars, second offense -- Fifty ($50.00) Dollars, third offense - One Hundred ($100.00) Dollars.
