ORDINANCE NO. �70-
AN ORDINANCE PROHIBITING THE TAMPERING OR
DAMAGING OF PUBLIC PROPERTY, BUILDINGS AND
OTHER PUBLIC IMPROVEMENTS; PROVIDING A
PENALTY THEREFOR, REQUIRING A DECAL NOTICE
ON EACH PUBLIC IMPROVEMENT AFFECTED; REPEAL-
ING ALL ORDINANCE5IN CONFLICT; AND FOR
OTHER PURPOSES:
WHEREAS, the Council of the City of Tamarac has been
advised of certain damage to City property and improvements,
and specifically to damage to sprinkling equipment and lawn
maintenance equipment; and,
WHEREAS, the Council has taken due notice of the
substantial value of the sprinkling equipment, lawn maintenance
equipment and other public property and improvements and% deems
it wise and expedient to make an affirmative effort to protect
said property from damage, intrusion or tampering by any person
and further deems it wise and expedient to provide a substantial
penalty for the violation thereof; provided, however, prior to
the mandatory sentence pursuant to a conviction hereunder, it
must be proved that a decal stating that the tampering with the
said property is a violation of City law and the minimum of
One Hundred Dollar ( $100.00 ) fine shall be imposed for said
violation; now,therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:
SECTION 1: That it shall be unlawful for any person
to tamper with, break into or otherwise damage any property,
building or improvement owned or controlled by the City of Tamarac.
SECTION 2: Any person

SECTION 3: The appropriate City official shall cause
a decal to be made, said decal stating substantially as follows:
that the tampering, breaking into or damaging of public property
as defined in this ordinance is a violation of City ordinance

decal shall be placed upon all public property, buildings, or other

public improvements in a clear and conspicuous place.
SECTION 4: Should any section or provision of
this ordinance or any portion thereof, or any paragraph, sentence
or word be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the validity of the remain-
der hereof as a whole or any part hereof, other than the part
declared to be invalid.
SECTION 5: All ordinances or parts of ordinances
in conflict herewith be and the same are hereby repealed.
