HomeMy WebLinkAboutCity of Tamarac Ordinance O-1970-013ORDINANCE NO. 70- 1�a AN ORDINANCE ESTABLISHING RULES AND REGULA- TIONS FOR SWIMMING POOL, SHUFFLEBOARD FACILITIES AND TAMARAC LAKES SOUTH GOLF COURSE; PROVIDING A SAVINGS CLAUSE; REPEALING ALL ORDINANCES IN CONFLICT THEREWITH: AND FOR OTHER PURPOSES. WHEREAS, the Council of the City of Tamarac has been advised that each recreation area within the City of Tamarac has independent rules and regulations regulating uses of their respective swimming pools and shuffleboard courts, and Tamarac Lakes South Golf Course has certain rules and regulations per- taining to the use of said golf course, and the Council has been requested by the various Associations to codify pool, shuffleboard and golf course regulations, and deems it to be in the public interest to do so; now, therefore, RE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The following regulations shall be applicable to all recreation area swimming pools. A. Only members, as defined in the deed restrictions applicable thereto, and bona fide guests shall be permitted to enter the swimming pool area. A bona fide guest need not necessarily be a house guest of an active member of the Association, but shall also include casual guests who are not overnight visitors of members. B. All guests utilizing the swimming pool area must be identified by a refundable identification tag and must be registered in the Association's guest book. C. Everyone must shower before entering the swimming pool. D. All persons with long hair extending below the ear lobe and/or below the nape of the neck must wear bathing caps when in the pool. ORDINANCE NO. 70 13 _(Continued) • E. No person five (5) years of age or under shall be permitted in the pool at any time. F. No floats, rafts, scuba equipment, balls or other pool paraphenalia permitted in the swimming pool. G. No oils or suntan lotions shall be applied prior to entering the pool. H. No running, jumping or shoving permitted. I. No containers of food or other edible products at poolside, including the concrete area surrounding the pool. J. Persons with wet bathing suits not allowed in the respective recreation area clubhouse. K. No glass containers of any type allowed in the pool area, including the concrete areas surrounding the swimming pool and the recrea- tion area. L. No dogs, cats or other animals or pets allowed in or around the recreation area. M. All children from ages six (6) to fifteen (15) years eleven (11) months and thirty (30) days of age must be accompanied by a parent or a responsible guardian designated by the parent, unless there are no deed restrictions in the area prohibiting children from living therein. N. Each individual house owner in the City of Tamarac shall be accountable for any physical damage to the clubhouse, pool, recreation grounds, buildings and appurtenances caused by him or her, their visitors, and in the case of rental property, their tenants. 0. Tenants shall be instructed to participate in the use of the clubhouse, pool, recreation grounds, buildings and appurtenances. The owner shall be held liable for any physical - 2 - 1�1 ORDINANCE NO. 70 - (Continued) damage to the above mentioned property by tenants. In cases of obnoxious behaviour, rights of tenants shall be denied. SECTION 2: The following regulations shall be applicable to all recreation area shuffleboard courts. A. Only members, as defined in the deed restrictions applicable thereto, and bona fide guests shall be permitted to enter the shuffleboard court area. A bona fide guestne+ed not necessarily be a house guest of an active member of the Association, but shall also include casual guests who are not overnight visitors of members. B. Children ten (10) years of age or under are not permitted to use the shuffleboard court. C. Children between the ages of eleven (ll) and eighteen (18) must be accompanied and super- vised by a parent or responsible guardian designated by the parent. D. All persons using the courts must have an identification badge provided the particular Association. E. Running, jumping, shoving or boisterous behaviour shall not be permitted on or about the shuffle- board courts. F. No glass containers allowed for any purpose. G. Special hours may be set aside for both men and women's tournaments, said tournaments and time to be determined by the civic association, H. No dogs, cats, or other animals or pets allowed at or near the shuffleboard area. I. Equipment must be returned to the storage area. J. No walking allowed on the playing surface. 3 - is ORDINANCE NO. 70- (Continued) K. only rubber -tipped or non --abrasive fiber sticks may be used to move the pucks. SECTION 3: The following regulations shall be applicable to Tamarac Lakes South Golf Course: A. Only members, as defined in the deed restrictions applicable thereto, and bona fide guests shall be permitted to use the gold course. A bona fide guest need not necessarily be a house guest of an active member of the Association, but shall also include casual guests who are not overnight visitors of members. S. All persons utilizing the golf course must have, in plain view, their identification badges; said badges to reflect whether they are residents or guests. Children and grandchildren of residents, sixteen (16) years of age and over, may play alone if they wear residents badge or guest badge. Residents' children and grandchildren under the age of sixteen (16) years, must be accompanied by the resident and play at their own risk. C. Owners who rent their homes may transfer their play- i ing privileges to the renter, however, if the renter has guests he must accompany them at all times. An owner, once having transferred his playing privil- eges to the renter, cannot retain them for himself. An owner may not transfer his guest badge to the renter. D. Not more than four (4) players shall play together as a group. E. Each player must have a putter and at least one other club. F. Passing of clubs from one player to another on the course at the time of play is not allowed. G. No dogs, cats, or other animals or pets allowed on the golf course. H. All players must wear shoes, walking shorts or slacks, and all male players must wear shirts. - 4 - 1 ORDINANCE NO. 70- 1,20 (Continued) I. Members shall be subject to such ether rules and regulations as may be stated on the score cards. SECTION 4: Any person charged with violating any of the provisions set forth in Section 1 and Section 2 above, after arrest by the Police Department of the City of Tamarac, and adjudicated guilty in the Municipal Court of the City of Tamarac, may be fined by a fine not exceeding $500.00, or im- prisoned for a time not exceeding ninety (90) days, or a combination of such fine or imprisonment. SECTION 5: Should any section or provision of this ordinance or any portion thereof, or any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be invalid. SECTION 6: All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. PASSED FIRST READING this '_day of 1970. PASSED SECOND READING this 4thday of May _, 1970.
