HomeMy WebLinkAboutCity of Tamarac Ordinance O-1970-024CITY OF TAMARAC, FLORIDA ORDINANCE # 'J( AN ORDINANCE PROHIBITING THE OPENING OR CUTTING OF ANY PAVEMENT OR STREET OR THE CUTTING OF ANY CURB ADJACENT TO ANY STREET OR THOROUGHFARE WITH OUT OBTAINING A PERMIT HEREFORE: PROVIDING FOR A PERMIT; PROVIDING MIN- IMUM STANDARDS FOR THE RESTORATION OF PAVEMENT OR STREET CUTS; PRO- VIDING A PENALTY FOR THE VIOLATION OF THIS ORDINANCE; REPEALING ALL ORDINANCES IN CONFLICT. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: Section 1: No person, firm or corporation • shall open any street or alter or cut any curb adjacent to any street or thoroughfare without first obtaining a permit from the City of Tamarac authorizing such alteration or change or pavement cut. Section 2: (a) The applicant for said permit shall pay to the City as a permit fee a sum in the amount of Seven Dol- ($7.50) lars and fifty cents T per traffic lane crossed by any such street cut. (b) A cut of any sidewalk or other thoroughfare other than a traffic lane as provided for in subparagraph (a) shall require a permit fee in the amount of Five ($5.00) Dollars. Section 3: Restoration of any such pavement or street cut shall be in accordance with the alternate methods designated method "A" and method "B" as shown on the diagram designated Exhibit "A", attached hereto, or any other method approved in writing by the City Engineer. Section 4: The City Building Inspector shall have jurisdiction and shall inspect the restoration two times during the course of the restoration. One such inspection shall be made prior to the pouring of any concrete and the second inspection shall be a final inspection. Section 5: Any restoration as provided for herein shall be completed within ten days from the date of the pavement or street or curb cutting. whenever such restoration is not completed within said ten (10) day period the applicant for the original permit as provided for herein shall re- apply for an additional ten (10) day extension of his permit and the fee therefore shall be the same as the original fee paid for the initial permit. . Section 6: Any person who shall be convicted of a violation of this ordinance shall be punished by a fine not exceeding the sum of Five Hundred ($500.00) Dollars or by imprisonment for not more than ninety days or both such fine and imprisonment. Section 7: All ordinances and parts of ordinances in conflict herewith are hereby repealed. PASSED FIRST READING this day oft�U,Wj 1970. PASSED SECOND READING this day of 1970.
