CITY OF TAMARAC, FLORIDA
ORDINANCE # '9
AN ORDINANCE PROVIDING FOR SPECIFICATIONS,
REQUIREMENTS, PROCEDURE, AND INSPECTION OF
LOTS AND SPRINKLER SYSTEMS THAT ARE TO ULTI-
MATELY BECOME THE RESPONSIBILITY OF THE CITY
OF TAMARAC TO MAINTAIN; PROVIDING FOR AN IN-
SPECTION FEE; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE.
WHEREAS, the City of Tamarac, through various
means, has become responsible for the maintenance of lawns
and sprinkler systems upon privately owned property; and
WHEREAS, to properly provide the aforesaid main-
tenance it is necessary that certain requirements, regula-
tions, inspections, and restrictions be established; and
WHEREAS, the City Council is now desirous of
setting forth the aforesaid.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL of
the City of Tamarac, Florida.
SECTION 1: That the provisions set forth in this
Ordinance shall apply to all lots constructed upon after the
effective date of this Ordinance and to all lots presently
under construction to which laying of thelawn and installa-
tion of the sprinkler system have not been completed.
SECTION 2: That this Ordinance shall only affect
those lots or parcels of land that the City of Tamarac will
ultimately become responsible for the lawn and sprinkler main-
tenance of.
SECTION 3: The sequence of lot completion shall
be as follows unless exception is specifically authorized
in writing by the Building and Inspection Department.
A. Lot must be cleared of all construction,
debris and detrimental rocks and boulders.

B. Lot must be properly graded.
C. Sprinkler system must be completely in-
stalled and tested.
D. Lawn must be completely installed.
SECTION 4: That after construction of the building,
dwelling or other structure is substantially completed, the
surrounding lot is to be cleared of all building and con-
struction debris, including but not limited to wire, plaster,
metal materials, wood, cement, paper and asbestos materials.
In addition, each lot is to be cleared of all rocks and/or
boulders of substantial size that might interfere with the
accomplishment of a smoothly graded surface. Under no cir-
cumstances is any building debris or rocks or boulders of
detrimental size to be buried on the lot.
SECTION 5: Prior to the laying of any sod or seeding
of any lawn, each lot is to be properly compacted and graded in
accordance with the requirements of the South Florida Building
Code, its Amendments and/or any other Building Code or Ordinance
in effect in the City of Tamarac at the time of such grading.
All such grading must be done to assure proper drainage, in-
cluding but not limited to drainage of water from each lot to
the street, or to storm sewers or to other drainage facilities
provided nearest to the subject lot.
SECTION 6: Finished grading of each subject lot must
be completed before the sod is laid to insure that a level con --
tour of the finished lawn will be accomplished.
SECTION 7: Installation of all Sprinkler Systems
shall be done pursuant to the following specifications and
requirements:
A. All trunk lines shall be located and in-
stalled a minimum of twelve inches below
the sod level.

B. All feeder lines shall be located and in-
stalled a minimum of six inches below sod
level.
C. All arterial lines shall be located and in-
stalled a minimum of four inches below sod
level.
D. All hydraulic and/or electric lines that
run to each valve from the controller shall
be located and installed a minimum of eight
inches below sod level. All such lines must
be made of a material that is suitable for
underground burial as provided for in the
South Florida Building Code or properly
encased, therefore suitable for burial.
E. All multi lot system valves excepting vacuum
breakers, must be encased in a protective
housing and installed so as to provide easy
access for repair and maintenance. Such pro-
tective housing should be installed so that
it is flush with the top of the sod level.
All controllers and pumps must either be
manufactured in a manner so that they will
be weather proof or installed in and protected
by a weather proof casting.
F. All sprinkler heads except stand pipe knocker
heads are to be installed in such a fashion
to insure that they will not extend above the
sod level.
G. All sprinkler heads except stand pipe knocker
heads are to have cement doughnuts placed
around them for protection.
SECTION S: All new lawns installed, when required,
must be rolled, to insure an even appearance.

SECTION 9: In the event of repair or replacement
of existing lawns, the replacement must be of a kind and
nature that will be consistent with the remainder of the lawn.
SECTION 10: Any person, firm or corporation request-
ing a building permit to construct a structure upon a lot con-
templated for maintenance as required by this Ordinance shall
be required to request and receive concurrently a permit for
the installation of a lawn and/or sprinkler system. Said permit
will be issued by the Building and Inspection Department of the
City of Tamarac contemporaneously with the issuance of building
permits.
SECTION 11: For each permit required by this Ordinance
the City Building and Inspecting Department is hereby required
to charge and collect the following fees:
A. $4.00 for a .lawn only permit.
B. $4.00 for a sprinkler system only permit.
C. $7.00 for a lawn and sprinkler system permit.
SECTION 12: All monies collected by the City Building
and Inspecting Department for fees as required by this Ordinance
shall be deposited in the General Fund of the City. Upon com-
pletion of installation of lawns, as required by this Ordinance,
and/or upon completion of installation of lawns and sprinkler
systems, as required by this Ordinance, the person, firm or
corporation holding the permit shall request, on a form pro-
vided by the City Building and Inspecting Department, a final
inspection. The City Building and Inspecting Department, un-
less there are unusual and extenuating circumstances, shall
make a final inspection within two working days of receipt
of written request by the holder of the permit. Said final
inspection shall be on a lot by lot permit by permit basis.
SECTION 13: Each final inspection, as contemplated
herein, shall include but not be limited to the following:
A. An inspection to insure proper grading.

B. An inspection to insure proper removal
of debris, rocks and boulders.
C. An inspection to insure proper installation
of the entire sprinkler system.
D. An actual visual and manual test of the
operation of the sprinkler system.
E. An inspection of the installation of the
lawn.
SECTION 14: In addition to the final inspection, as
contemplated herein, the Building and Inspecting Department of
the City of Tamarac shall at any time it deems necessary, in-
spect and require the cooperation of the person holding the
permit, to insure that all requirements of this Ordinance are
being adhered to.
SECTION 15: Prior to or at the time of final inspec-
tion, the person holding the permit shall provide to the Building
Department the following:
A. An "as built" schematic showing the place-
ment and location of all sprinkler main lines
including but not limited to, those installed
under roads, on easements, and right of ways.
Said maps must also show and include the lo-
cation and type of all valves, whether they
be hand valves, electric valves or hydraulic
valves. The diagrams shall also include the
location of all controllers, clocks and pumps.
In the event the system is tied into any
municipal or other Utility water system, the
location of all vacuum breakers must also be
indicated.
B. Warranties on all warrantied parts and me-
chanical devices used, including but not
limited to pumps, motors, clocks, controllers,
and valves.

C. A guaranty, running from the person holding
the permit or the contractor or the developer,
to the City of Tamarac, guarantying for a
minimum period of 120 days any defects in
workmanship as to trunk lines, pumps, motors,
clock controllers and valves.
SECTION 16: The Building and Inspecting Department may,
upon receipt of the maps, warranties, and guaranties, as herein
provided for and after final inspection, as herein provided for,
issue a Certificate of Lawn Acceptance, or a Certificate of
Sprinkler Acceptance or a Certificate of Lawn and Sprinkler
Acceptance, whichever the case may be. Should there be a failure
in compliance with any provision of this Ordinance, then the City
Building and Inspecting Department is authorized to withhold issu-
ance of a Certificate as herein provided until such compliance.
SECTION 17: The City Building and Inspecting Department
shall not issue a Certificate of Occupancy for the building, in
cases where a Certificate, as herein required for lawn and/or
sprinklers, is not issued. However, the City Building and In-
specting Department is hereby authorized to issue a temporary
Certificate of Occupancy for a period of up to 90 days where
extenuating and substantial reasons have prevented full compliance
with the terms of this Ordinance. Upon full compliance of the
terms of this Ordinance and the issuance of a Certificate as
herein provided for, the City Building and Inspecting Department
is authorized to issue a final Certificate of Occupancy or -regu-
lar Certificate of Occupancy.
SECTION 18: Notwithstanding any other provision of this
Ordinance and only during the recognized existence of that cer-
tain contract presently binding the City of Tamarac and Garden
And Landscape, Inc., prior to the issuance of Certificate of Lawn
and/or Sprinkler Acceptance by the City Building and Inspecting
Department, additional written acceptance must be provided to the
City by Garden And Landscape, Inc. The person requesting accept-
ance of the City Building and Inspecting Department shall also

contemporaneously with said request make request for acceptance
to Garden And Landscape, Inc. Garden And Landscape, Inc. shall
not unreasonably withhold acceptance after receiving said requests
and should make every effort to make inspection within two work-
ing days of receipt of request. Garden And Landscape, Inc. shall
file their written acceptance or rejection and the reasons there-
fore with the Maintenance Committee and file a copy with the City
Building and Inspecting Department. The provisions of this sec-
tion shall in no way affect the City Building and Inspecting De-
partment's authority to issue temporary Certificate of Occupancy,
as herein provided for.
SECTION 19: The intent of this Ordinance and the pro-
visions herein are to require inspection and acceptance of lawns
and sprinklers on an individual lot basis. Upon acceptance by
the City Building and Inspecting Department and upon its issuance
of a Certificate, as herein provided, the City of Tamarac shall
at that point begin and provide maintenance.
SECTION 20: All Ordinances or parts of Ordinances in
conflict herewith are hereby repealed to the extent of such
conflict.
SECTION 21: Should any section or provision of this
Ordinance or any portion hereof, or any paragraphs, sentence
or word be declared by a Court of competent jurisdiction to
be invalid, such decision shall not affect the validity of
the remainder hereof as a whole or any part hereof, other
than the part declared to be invalid.
