CITY OF TAMARAC, FLORIDA
ORDINANCE #C 6
AN ORDINANCE AMENDING ORDINANCE NO. 64-1
SECTION 4.02b REPEALING ALL ORDINANCES
IN CONFLICT HEREWITH PROVIDING A SAVINGS
CLAUSE.
WHEREAS, the City Council, City of Tamarac, deems
it necessary and in the best interests of the public health,
safety, welfare and morals to establish a new set back
requirement for construction within C-1 zoned commercial
districts.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL of
the City of Tamarac, Florida:
SECTION 1: That Section 4.02E of Ordinance # 1--64
is hereby amended to read as follows:
b. Where any building is constructed or
used in a C-1 district for purposes allowed under
Section 4.Olb above, such building shall have a
minimum front yard set back from the street line
of twenty-five (25) feet and shall have a minimum
rear yard of five (5) feet. Buildings on corner
lots shall have a minimum side yard set back of
twenty-five (25) feet from the street line in
addition to the front yard set back herein required.
Where a C--1 district directly abuts on a residential
district without any separation between them such as
a street, alley, canal or other public open space,
then any plot in such non-residential district shall
be provided with a yard at least twenty-five (25)
feet in depth adjacent to the residential zoned
property.
SECTION 2: All Ordinances or parts of Ordinances
in conflict herewith are hereby repealed to the extent of such
conflict.
SECTION 3: should any section or provision of this
Ordinance or any portion hereof, or any paragraphs, sentence
or word be declared by a Court of competent jurisdiction to be
invalid, such decision shall not affect the validity of the
remainder hereof as a whole or any part hereof, other than
the part declared to be invalid.
