HomeMy WebLinkAboutCity of Tamarac Ordinance O-1970-044CITY OF TAMARAC, FLORIDA ORDINANCE # Z R Y AN ORDINANCE AMENDING ORDINANCE NO. 64-1 SECTION 4.02b REPEALING ALL ORDINANCES IN CONFLICT HEREWITH PROVIDING A SAVINGS CLAUSE. WHEREAS, pursuant to the instruction of the City Council of the City of Tamarac, Florida, public notice has been given in accordance with the applicable law of the time and place of public hearing regarding the zoning ordinance described herein, and the said public hearing has been held in accordance with the notice and the public has been given an opportunity to be, and has been heard; and the Council has' examined and investigated the ordinance and its contents, and WHEREAS, public hearing has been held by the City Council pursuant to the Charter, and WHEREAS,the City Council, City of Tamarac, deems it necessary and in the best interests of the public health, safety, welfare and morals to establish a new set back require- ment for construction within C-1 zoned commercial districts. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL of the City of Tamarac, Florida: SECTION 1: That Section 4.02b of Ordinance No. 64-1 is hereby amended to read as follows: b. Where any building is constructed or used in a C-1 district for purposes allowed under Section 4.Olb above, such building shall have a minimum front yard set back from the street line of twenty-five (25) feet and shall have a minimum rear yard of five (5) feet. Buildings on corner lots shall have a minimum side yard set back of twenty-five (25) feet from the street line in addition to the front yard set back herein required. Where a C-1 district directly abuts on a residential district without any separation between them such as a street, alley, canal or other public open space, then any plot in such non-residential district shall be provided with a yard at least twenty-five (25) feet in depth adjacent to the residential zoned property. SECTION 2: All Ordinances or parts of Ordinances in con- flict herewith are hereby repealed to the extent of such conflict. SECTION 3: Should any section or provision of this Ordinance or any portion hereof, or any paragraphs, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be invalid.
