AN ORDINANCE AMENDING ORDINANCE 72- 29 by
AMENDING SECTIONS 45 and 47 OF ARTICLE II
THEREOF TO REFLECT THE REPEAL OF FLORIDA
STATUTES CHAPTER 205 AND THE EFFECTIVE
DATE OF FLORIDA STATUTES 166.221 TO CARRY
OUT THE INTENT OF ORDINANCE 72-29; PROVIDING
A SAVINGS CLAUSE; REPEALING LAWS IN CONFLICT;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, Chapter 205 Florida Statutes is repealed
effective September 30 1973, and
WHEREAS Florida Statutes 166.221 becomes effective
October 1 1973 and provides for the levy by municipalities of
an Occupational License tax, and
WHEREAS, the City Council desires to ratify the
terms of Ordinance 72-29 and properly reflect the State enabling
laws,
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF TAMARAC, FLORIDA:
SECTION 1: That Section 45 of Article II of
Ordinance 72-29 is hereby amended to read as follows:
"SECTION 45:
EFFECTIVE DATE.
The terms and provisions of this Ordinance shall
become effective upon its final passage and shall
reflect the change in State law by virtue of
Florida Statutes Chapter 166.221."
SECTION 2: That Section 47 of Article II of
Ordinance 72-29 is hereby amended to read as follows:
"SECTION 47:
That nothing in this Ordinance shall be deemed
to impose an Occupational License on any business
or occupation except as authorized by Florida Statute
Chapter 166.221. In all other respects Ordinance
72-29 is hereby ratified."
SECTION 3: Should any Section or provision of
this Ordinance or any portion hereof, or any paragraphs, sentence
or word be declared by a Court of competent jurisdiction to be
invalid, such decision shall not affect the validity of the
remainder hereof as a whole or any part hereof, other than the
part declared to be invalid.
SECTION 4: All Ordinances or parts of Ordinances
in conflict herewith are hereby repealed to the extent of such
conflict.
