AN ORDINANCE AMENDING SECTION 123 OF ARTICLE XIX OF THE CITY CHARTER OF THE CITY OF TAMAi2AC RELAT- ING TO DUTIES AND POWERS; PROVIDING AN EFFECTIVE DATE AND PROVIDING FOR VOTER APPROVAL BY REFEREN- DUM. WHEREAS, the City Council is authorized to submit Charter Amendments to the electors of the City by referendum pursuant to the provisions of Section 166.17 FLORIDA STATUTES, and WHEREAS, the Council deems the subject amendment to be desirable. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE City of Tamarac, Florida: SECTION 1: That Section 123 of Article XIX of the City Charter is hereby amended to read as follows: "SECTION 123. DUTIES AND POWERS The Charter Board shall have the power to investigate violations of the Charter of the City of Tamarac, hold public hearings, subpoena witnesses, take testimony, make findings and submit reports on results of investigations to the appropriate authorities. The Charter Board shall have the powers and duties as provided for in Chapter 166, FLORIDA STATUTES, to the extent that said Statutes are not inconsistent with the provision of this Charter. The Citizens shall have the right to complain of any Charter violations to the Charter Board and the Charter Board shall consider said complaint. The Charter Board shall not institute any Court action without approval of Council." SECTION 2: That this amendment shall become effective upon approval by a majority of the electors voting in a referendum upon such amendment. SECTION 3: That the referendum on this Ordinance shall be held at the general election in the City of Tamarac, 1973.
