HomeMy WebLinkAboutCity of Tamarac Ordinance O-1973-023This r was Is introduced by CITY OF TAMNRAC, FLORIDA ORDINANCE NO. -j „fW Temporary No.- --- n AN ORDINANCE AMENDING SECTION 115 OF ARTICLE VI OF THE CITY CHARTER OF THE CITY OF TAMARAC RELATING TO CONTRACTS FOR PUBLIC WORKS; PROVIDING AN EFFECTIVE DATE AND PROVIDING FOR VOTER APPROVAL BY REFERENDUM. WHEREAS, the City Council is authorized to submit Charter Amendments to the electors of the City by referendum pursuant to the provisions of Section 166.17 FLORIDA STATUTES, and WHEREAS, the Council deems the subject amendment to be desirable. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE City of Tamarac, Florida: SECTION 1: That Section 115 of Article VI of the City Charter is hereby amended to read as follows: "SECTION 115. CONTRACTS FOR PUBLIC WORKS Whenever the cost of the proposed public improvement is to be paid or repaid, in whole or in part, by special assessments levied against the property specially benefited, the pib„ceedings shall be in accordance with the provisions relative to Special Assessments for Local Improvements elsewhere contained in this Charter; whenever the professional services of architects, engineers, surveyors, attorneys, and the like, are required, in connection with.a public improvement, contracts of employment may be entered into by the Council with such persons, without the necessity of public competitive bids. Faithful performance bond written by corporate surety company holding a certificate of authority from the Secretary of the Treasury of the United States as acceptable sureties on Federal bonds, and executed and issued by a resident agent licensed and having an office in Broward County, Florida., representing such corporate surety, shall be required from the successful bidder in an amount equal to the contract price. 0 l Faithful performance bond, contract, contract documents, qualifi- cations of bidders, and plans and specifications shall be prepared and executed in accordance with requirements of the Engineering Department, approved by the City Attorney. Whenever general funds, in excess of $10,000.00,are to be used or obligated for a public improvement, a referendum may be demanded by a petition of any 200 citizens, filed with the City Clerk within ten (10) days of said Council action." SECTION 2: That this amendment shall become effective upon approval by a majority of the electors voting in a referendum upon such amendment. SECTION 3: That the referendum on this Ordinance shall be held at the general election in the City of Tamarac, 1973.
