AN ORDINANCE AMENDING SECTION 92 OF ARTICLE XIV
OF THE CITY CHARTER OF THE CITY OF TAMAR4C
RELATING TO CONTINGENCY RESERVE ACCOUNTS;
PROVIDING AN EFFECTIVE DATE AND PROVIDING FOR
VOTER APPROVAL BY REFERENDUM.
WHEREAS, the City Council -is authorized to submit Charter
Amendments to the electors of the City by referendum pursuant to
the provisions of Section 166.17 FLORIDA STATUTES, and
WHEREAS, the Council deems the subject amendment to be
desirable.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE City of
Tamarac, Florida:
SECTION 1: That Section 92 of Article XIV of the City
Charter of the City of Tamarac is hereby amended to read as follows:
"The City Manager is authorized to establish contingency
reserve accounts. Contingency reserve is hereby defined as a fund
for unanticipated expenditures arising out of events occurring
during the course of the budget year, included but not limited to
annexation, population growth, litigation, legislation, and other
special problems. A contingency reserve account shall not
exceed 5% of the general fund budget and Sa of the Utility fund
budget.
No funds shall be expended from the contingency reserve
account, but transfers of funds may be made from such account pro-
vided that such proposed transfer has been made a part of the
agenda of the Council Meeting at which such transfer is made.
All other transfers of funds shall also be made by Council
action at a meeting for which such proposed transfer has been
listed as an agenda item. Inter -departmental transfers shall
be considered appropriations and shall only be made after publication
in one or more newspapers of general circulation in the City, of
the time and place, not less than two (2) weeks after such publication,
for a public hearing on such proposed appropriation.,,
SECTION 2: That this amendment shall become effective upon
approval by a majority of the electors voting in a referendum
upon such amendment.
SECTION 3: That the referendum on this Ordinance shall be
held at the general election in the City of Tamarac, 1973.
SECTION 4: This Ordinance shall become effective immediately
upon its final passage.
