ORDINANCE NO.
AN ORDINANCE REPEALING ORDINANCE NO. 70-24
AND PROHIBITING THE OPENING OR CUTTING OF
ANY PAVEMENT OR STREET OR MEDIAN OR THE
CUTTING OF ANY CURB ADJACENT TO ANY STREET
OR THOROUGHFARE WITHOUT OBTAINING A PERMIT
THEREFORE; PROVIDING FOR A PERMIT; PROVIDING
FOR A PERFORMANCE BOND; PROVIDING MINIMUM
STANDARDS FOR THE RESTORATION OF PAVEMENT OR
STREET CUTS OR MEDIAN CUTS; PROVIDING A
PENALTY FOR THE VIOLATION OF THIS ORDINANCE;
REPEALING ALL ORDINANCES IN CONFLICT;
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: No person, firm or corporation shall open any streets
or median or alter or cut any curb adjacent to any street or thoroughfare
without first obtaining a permit from the City of Tamarac authorizing
such alteration or change or pavement or median cut.
SECTION 2: The applicant for said permit shall pay to the City
as a permit fee a sum in accordance with the following schedule:
a. Street cuts
Streets paved within one year prior to
application:
Streets paved within two years prior
to application:
Streets paved more than two years prior
to application:
b. Median cuts
Per median cut:
c. Sidewalks or thoroughfare not traffic lanes
Each sidewalk or non -traffic lane
thoroughfare:

SECTION 3: Restoration of any such pavement or street cut shall
be in accordance with the alternate methods designated method "A", method
"B", method "C", or in accordance with the method shown on "Typical Median
Opening" diagram, attached hereto, or any other method approved in writing
by the City Engineer.

SECTION 4: The City Engineer shall have jurisdiction
and shall inspect the restoration two times during the course of
the restoration. One such inspection shall be made prior to the
pouring of any concrete and the second inspection shall be a
final inspection.
SECTION 5(a): Any restoration as provided for herein
shall be completed within 48 hours from the cutting of the
pavement, street, curb, or median, or within such time as
approved in writing by the City Engineer.
SECTION 5 b : During the course of cutting and restoring
any thoroughfare or street which consists of more than one lane
in either direction, not more than one lane in either direction
may be rendered impassable by traffic at any given time. Where
practical, steel plates shall be used to facilitate thru traffic
during the period of construction. In all cases the time during
which work will be permitted shall be governed by the City
Engineer.
SECTION 6: In addition to the foregoing requirements,
the person, developer, owner, or owners or contractor or
subcontractor who shall apply for street cut permits shall
furnish to the City a good and sufficient bond, in the full amount
of the cost of the required restoration of the street improvements
in accordance with the requirements of this Ordinance. The
amount of the bond shall be determined by the City Engineer.
Said bond shall be furnished by a surety company of recognized
standing authorized to do business in the State and having a
resident agent in Broward County; provided, however, that the
person may at his or their option furnish cash in the same amount,
conditioned upon the completion of all required restorations
within a period not to exceed the 48-hour limit set hereinbefore.
The contractor, subcontractor or other person making the street
cut or having obtained a permit for same shall be responsible
for the paving until said work is accepted by the City through
its designated agent, city engineer or city building inspector

and the bond is released.
SECTION 7: Any person who shall be convicted of a
violation of this Ordinance shall be -punished by a fine not
exceeding the sum of five hundred dollars ($500.00) or by
imprisonment for not more than ninety days or both such fine
and imprisonment.
SECTION 8: All Ordinances or parts of Ordinances in
conflict herewith are hereby repealed.
SECTION 9: This Ordinance shall become effective
immediately upon its final passage.
