AN ORDINANCE REPEALING ORDINANCE 72-9 AND AMENDING ORDINANCE 1-64 OF THE CITY OF TAMARAC BY AMENDING SECTION 10.41 PROVIDING FOR SPECIAL USE EXCEPTIONS TO PERMIT THE SALE AND CONSUMPTION ON THE PREMISES OF ALCOHOLIC BEVERAGES AS AN ACCESSORY USE TO A RESTAURANT LOCATED IN A B-1 DISTRICT; PROVIDING FOR LIMITATIONS ON ADVERTISING, SIGNS AND FLOOR AREA; ESTABLISHING PROCEDURES; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That Ordinance No. 72--9 of the City of Tamarac is hereby repealed, and Ordinance No. 1-64 of the City of Tamarac be amended, by amending Section 10.41 thereof to read as follows: "SECTION 10.41 - SPECIAL USE EXCEPTION. The City Council, following the procedures adopted by the City of Tamarac for special exceptions, may, by resolution, grant a special use exception per- mitting the sale and consumption on the premises of alcoholic beverages as an accessory use to a restaurant located in the B-1 District. The restaurant shall have all licenses required by the State of Florida for such use; there shall be no outside advertising or signs with respect to the sale of alcoholic beverages; and not more than 10% of the gross floor area of the restaurant shall be used exclusively for the sale and consumption of alcoholic beverages." SECTION 2: Should any section or provision of this ordi- nance or any portion thereof, or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be invalid. SECTION 3: This Ordinance shall become effective immediately upon its final passage.
