HomeMy WebLinkAboutCity of Tamarac Ordinance O-1973-077-r r S introduced by i CITY OF TAMARAC, FLORIDA ORDINANCE NO. tj — AN ORDINANCE AMENDING ORDINANCE NO. 1-64 BY AMENDING ARTICLE V, SECTION 5.04, BY PROVIDING FOR A MORATORIUM ON BUILDING PERMITS AND SITE PLAN REVIEWS FOLLOWING RECOMMENDATION OF THE CERTAIN CHANGES IN ZONING BY THE ZONING COMMISSION; PROVIDING AN EFFECTIVE DATE; PROVIDING A SAVINGS CLAUSE; REPEALING ALL LAWS IN CONFLICT BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That Ordinance No. 1-64 is hereby amended by amending Article V, Section 5.04, thereof by adding a new subparagraph (f): "5.04 (f) In any case where the Zoning Commission has received or initiated a petition to rezone property from a less restrictive district to a more restrictive district (within the same category, i.e., residential or commercial) and causes a notice of public hearing to be published, then from the date of first publication of the notice of public hearing, the Building Department shall not issue a building permit, and shall not receive for review any site plan or building permit applications or documents in connection therewith with respect to the subject parcel of land for a use not permitted in the more restrictive district until the Zoning Commission's recommendation has been acted upon by the City Council. In any case where the Zoning Commission has received or initiated a petition to rezone a parcel of land from one category of zoning district to a different category of zoning district (i.e., from business to residential) and has caused a notice of public hearing to be published, then from the date of the first publication of the notice of public hearing, the Building Department shall not is- sue a building permit, and shall not receive for review any site plan or building permit applications or 1 documents in connection therewith with respect to the sub- ject parcel of land, for a use not permitted in the less intense district until the Zoning Commission's recommenda- tion has been acted upon by the City Council.." SECTION 2: In all other respects the provisions of Ordinance No. 1-64 of the City of Tamarac as heretofore amended shall remain in full force and effect. SECTION 3: In the event any section, subsection, paragraph, sentence, clause or phrase of this Ordinance shall be declared or adjudged invalid or unconstitutional by a court of competent jurisdiction, such adjudication shall in no manner affect the validity of the remainder of this Ordinance or any part thereof. SECTION_4: All Ordinances or parts of Ordinances, or resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: This Ordinance shall become effective immediately upon its final passage.
