AN ORDINANCE AMENDING ORDINANCE 72-5 BY AMENDING SECTIONS 2 AND 9 THEREOF AND ADDING A NEW SECTION 8A TO PROVIDE JURISDICTION IN AREAS PLANTED PRIOR TO THE EFFECTIVE DATE OF ORDINANCE 72-5; PROVIDING FOR ENFORCEMENT PROCEDURES BY THE CODE ENFORCEMENT OFFICER; PRO- VIDING A SAVINGS CLAUSE; PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY TIIE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That Section 2, Enforcement, of Ordinance 72-5 is hereby amended to read as follows: "This Ordinance shall be a minimum standard and shall apply to all of the incorporated area, and shall be enforced by the Chief Building Official and the Code Enforcement Officer of the City of Tamarac." SECTION 2: That Section 91, Penalty, of Ordinance 72-5 is hereby amended to read as follows: "The Building Inspector and Code Enforcement Officer of the City of Tamarac are hereby designated and authorized to enforce this Ordinance. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with, or who resists the enforcement of, any of the provisions of this Ordinance shall be fined Twenty -Five Dollars ($25.00). Each day a violation exists shall constitute a separate offense." SECTION 3: That a new Section, to be designated Section 8A of Ordinance 72-5, is hereby included as an amend- ment to Ordinance 72-5, said section to read as follows: "SECTION 8A. GRANDFATHERED AREAS. All areas which were landscaped prior to February 9, 1972, the effective date of Ordinance 72-5, are declared to be within the jurisdiction of this Ordinance to the extent that said areas shall be maintained in a manner consistent with the original landscaping and plantings. All such areas shall be maintained in a neat, clean, esthetically appealing 1 r- manner and further shall be kept free from all refuse, debris, and weeds. Failure to comply with the standards set forth in this Section shall subject the offender to the provisions of Sections 9 and 10 of this Ordinance." SECTION 4: Should any section or provision of this Ordinance or any portion thereof or any paragraph, word or sentence be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole, or any part hereof, other than the part declared to be invalid. SECTION 5: All Ordinances or parts of Ordinances in conflict are hereby repealed to the extent of such conflict. SECTION 6: This Ordinance shall become effective immediately upon its final passage.
