CITY OF TAMARAC, FLORIDA
ORDINANCE NO. 7Cp"i �-
AN ORDINANCE SETTING STANDARDS AND MINIMUM
AREA PER OCCUPANT, BASED ON FLOOR AREA OF
ASSEMBLY AREAS IN RECREATION BUILDINGS;
REPEALING ALL LAWS IN CONFLICT; CONTAINING
A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE
DATE
WHEREAS, the City Council of. the City of Tamarac, Florida
pursuant to its powers to regulate the zoning and building within
its boundaries, and
WHEREAS, ARTICLE IV, ACQUISITION AND DEVELOPMENT OF PARK
AND RECREATIONAL SITES, Section 20-40 through Section 20-48,
inclusive, now provides for certain lands within a subdivision
be dedicated to the City for parks or recreational purposes, or
a fee paid, or some combination of dedication and fee paid in
lieu therefore, as a prerequisite for final approval of the plat,
and
WHEREAS, ARTICLE IV,
Section 20-48 further
provides
and
sets forth certain standards,
for private ownership
of the
open
space for park and recreational purposes, by residents or future
residents in a proposed subdivision, and
WHEREAS, ARTICLE IV, does not provide for standards,
regulating open space for park and recreational purposes, title
to which is to remain in the developer, or his Assignee, Grantee
or other Designee, to be privately owned, which the owner intends
to encumber by purchase money mortgage or lease, irrespective of
the said lease period, and
WHEREAS, the Council of the City of Tamarac, recognizes
that the developer has several options available to him by virtue
of existing ordinances to satisfy the Code requirements, and
therefore wishes to provide certain standards, to protect the
health, welfare and safety of the citizens of Tamarac. Should
the developer choose to retain private ownership of the park and
recreational space to be provided to be used for park and recrea-
tional purposes for the residents and future residents of the

subdivision, as required under existing ordinances. In the event
that the developer chooses to provide as a part of the recreation
facilities a recreation building, to have as one of its uses an
assembly area, said assembly area shall meet certain minimum
standards as provided herein.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF TAMARAC, FLORIDA:
SECTION 1: Definition of an Assembly Area. For purposes
of this Ordinance an Assembly Area shall be defined as part of
a recreational building used for the gathering together of persons
primarily for the purposes of group meetings, deliberation or
entertainment.
SECTION 2: The minimum floor area proposed for room in
recreational buildings used for public or private assembly shall
be based on the following formula:
A. For each seat there shall be a minimum
net floor area of eight square feet.
B. The minimum seating capacity shall be one
seat for each eight tenths (.8) of the proposed total number of
units in the subdivision plat as filed.
SECTION 3: For the purpose of this Ordinance, the word
"net" as used in Section 2, Part A shall exclude stage area,
storage areas and other accessory use areas.
SECTION 4: The recreation building shall be located
within the subdivision area as platted and shall be zoned S-1.
SECTION 5: That should any section or provision of this
Ordinance, or any portion thereof, or any paragraph, sentence,
or word be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the validity of the
remainder thereof as a whole or any part thereof, other than the
part declared to be invalid.
SECTION 6: That all Ordinances or parts of Ordinances
in conflict herewith be and the same are hereby repealed.
