AN ORDINANCE AM DING CHAPTER 5 OF THE CODE
OF THE CITY OF TAMARAC; PROVIDING FOR SPECI-
FICATIONS, RDGULATIONS, AMID INSTALLATION OF
E)=IOR RADIO, T=ISION, OR HJUI CIVIC
ANTENNAE; PROVIDING FOR NOTICE OF VIOLATION;
PROVIDING A PENALTY FOR THE VIOLATION F;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;
PROVIDING FOR A SAVINGS CLAUSE AND PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, the Planning Commission of the City of Tamarac,Florida
has conducted an investigation concerning the installation of antennae
pursuant to the responsibilities outlined in 163 of the Florida Statute, and
WHEREAS, the Planning Commission of the City of Tamarac, Florida
has determined that it is in the best interest of Tamarac's health, welfare,
and safety to amend Ordinance 70-29B, the same being Chapter 5 Antennae and
Aerials of the Tamarac City Code, regulating the height and installation on
single family and duplex residential dwelling units.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC,

SECTION 1: Ordinance 70-29B the same being Chapter 5 Antennae and
Aerials of the Tamarac City Code, is hereby amended to read as follows:
Sec. 5-1 Applicability of Chapter
All outdoor radio, television and electronic antennae or antennae
of any other nature constructed upon, affixed to, structurally repaired or altered
upon, or otherwise emplaced to service or act in conjunction with the use of any
property for single story, all buildings over one (1) story height and commercial,
must comply with the requirements of this chapter.
Sec. 5-2 Su rt
Each antennae provided for in section 5-1 shall be installed in
accordance with the South Florida Building Code, Section 2306.
Sec. 5-3 Liqhtninq arrester and ground rod.
All antennae shall be provided with lightning arresters and
driven ground rods suitable for the particular purpose.
Sec. 5-4 Location and Placement.
All T.V. or radio antennae must be attached to the rear or side
wall or rear or side overhang of the dwelling. Corner lot dwellings must
locate the antennae on the roof side that will provide the least street
exposure. The antennae shall be attached to the roof overhang and the lead-
in wire shall be attached to the rear or side wall of the house, except
amateur and CB licensed operators antennae shall be placed at the rear wall
centered as near as practical between the side lot lines.
Sec. 5-5 Height.
1. No antennae shall be mounted in a manner that will exceed
a height of twenty feet for standard T.V. or radio antennae and 30 feet for
licensed amateur or CB radio operators, antennae measured from the top
elevation of the building slab of single family dwellings.
2. For all buildings over 1 story in height not to violate or
offend the aesthetic, safety or health and welfare intent of this chapter,
the Chief Building Official shall have the authority to approve or disapprove
the requested height of the installation of antennae, not exceeding ten feet
above the highest point of the building in question.
3. To install a licensed amateur or CB radio operators antennae,
proof has to be presented to the Chief Building Official to be a licensed
amateur or CB radio operator, before permission can be granted to install
an amateur or CB radio antennae.
Sec. 5-6 Installation of antennae used for commercial purpose and
or on commercial buildings.
1. Installation of or structural repair or alteration to
antennae for use in connection with commercial properties or buildings shall
not exceed ten feet in height above the building in question, special per-
mission should be required, requested

in writing through the Building Department from the Chief Building
Official which shall have the authority to set the height of the
antennae to approve or disapprove the installation of antennae as
aforesaid.
2. Should the circumstance arrive that permission will
be granted and the antennae height is 200 feet above ground, the
FCC required that only a lit antennae can be installed.
Sec. 5-7 Effect of chapter on installation in areas
where otherwise prohibited.
This section is heretofore repealed.
Sec. 5-8 Violations --Notices to persons responsible;
time allotted for correction.
Any person responsible for the erection of an antenna,
or responsible for the maintenance of an antenna
in violation of this chapter shall have thirty days from the delivery
of written notice, as provided for in this section, to correct
such violation. Written notice shall be provided by the Code
Enforcement Officer or any other designee of the City Manager,
by leaving same at the residence of the alleged violator, or by
mailing same by regular mail to the alleged violator or by leav-
ing same on the premises wherein the alleged violation is taking
place.
Sec. 5-9 Same --Powers of Chief Building Official, etc.
The Chief Building Official shall have the authority
to investigate and to make such inquiry as shall be necessary to
determine whether or not a violation is taking place, and in addi-
tion shall also have the authority to provide written notice of
violation as referred to in section 5-8. The Code Enforcement
Officer or any other designee of the City Manager will have the
authority to issue summons for violation of this chapter.
SECTION 2: All ordinances or parts of ordinances and all
sections of the Tamarac City Code or parts thereof in conflict here-
with be and the same are hereby repealed.
SECTION 3: Should any Section or provision of this Ordinance
or any portion hereof, or any paragraph; sentence or word be
declared by a Court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remainder hereof as
a whole or any part hereof, other than the part declared to be invalid.

SECTION 4: This Crdinance becomes effective imediately upon its
final passage.
