CITY OF TAMARAC, FLORIDA
ORDINANCE NO. -tg
AN ORDINANCE PROVIDING FOR DESIGNATION
OF LOCAL PLANNING AGENCY; PROVIDING FOR
DUTIES AND RESPONSIBILITIES; PROVIDING
A SAVINGS CLAUSE AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, Chapter 75-257, Laws of Florida, known as the
"Local Government Comprehensive Planning Act of 1975" (hereinafter
referred to as the "Act") requires the City of Tamarac, Florida to
designate a Local Planning Agency for the City of Tamarac, Florida
on or before July 1, 1976, and
WHEREAS, Section 6 of the Act further authorizes the Local
Planning Agency of the City of Tamarac, to prepare the Comprehensive
Plan in accordance with Section 7 of the Act after due public notice
is given and public meetings are held, and shall make recommendations
to the City Council regarding the adoption of such plan as required by
Section 4, on or before July 1, 1979.
WHEREAS, the Local Planning Agency shall oversee and
perform the planning functions as described in the Act;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE City
of Tamarac, Florida:
SECTION 1: DECLARATION OF INTENT
The City Council of the City of Tamarac, Florida hereby
declares its intent to exercise the authority granted to it by the
Act to create and designate a Local Planning Agency and to adopt and
establish a Comprehensive Plan for the City of Tamarac, within the
extent allowed by the provisions of the Act and the Broward County
Charter.
SECTION 2: DESIGNATION OF LOCAL PLANNING AGENCY
The City Council of the City of Tamarac, Florida hereby
designates Tamarac's Planning Commission as the Local Planning Agency
as provided by Section 6 of the Act.

SECTION 3 : DUi'IES AND RESPONSIBILITIES OF M- LOCAL PLANNING
AGENCY
(a) Tamarac's Department of Cbmuunity Development shall be responsible
for assisting in the preparation of the Comprehensive Plan in accordance with
Section 7 of the Act.
(b) The Planning Commission shall hold hearings after due public notice
prior to the City Council 's adoption of the Plan; shall prepare periodic reports on
the Plan to the City Council at least once every five years and shall monitor and
oversee the effectiveness and statutes of the Comprehensive Plan, and shall review
all proposed land development regulations before adoption by the City Council, as
stated by the Act.
(c) Tamarac's Planning Cbmnission shall make recommendations to the
City Council regarding the adoption of the Comprehensive Plan.
SECTION 4: SAVINGS CLAUSE
That should any section or provision of this Ordinance or any portion
thereof, or any paragraph, sentence, or word be declared by a court of competent
jurisdiction to be invalid and decision shall not affect the validity of the
rama.inder thereof as a whole or any part, thereof, other than the part declared
to be invalid.
SWrION 5: SEVERABILITY CLAUSE
Ordinances or parts of Ordinances in conflict herewith be and the same
are hereby repealed.
SECTION 6: EFFECTIVE DATE
This Ordinance shall become effective immediately upon its final passage.
