CITY OF TAMARAC, FLORIDA
ORDINANCE NO. '7(
AN ORDINANCE AMENDING ORDINANCE NO.
76-1 BY PROVIDING A WAIVER TO THE
REFUND PROCEDURES AND APPLICATION
FEE FOR THE REIMBURSEMENT OF CERTAIN
IMPACT FEES COLLECTED UNDER ORDINANCE
NO. 73-55 IN AMOUNTS OF $100.00 OR
LESS; PROVIDING A SAVINGS CLAUSE;
PROVIDING AN EFFECTIVE DATE
WHEREAS, the City Council, by Ordinance No.
76-1, established a procedure for the reimbursement
of certain impact fees collected erroneously, and
WHEREAS, there has been a judicial determi-
nation that certain impact fees collected under
Ordinance No. 73-55, City of Tamarac, Florida, should
be reimbursed, and
WHEREAS, the City Council has expressed a
desire to facilitate the reimbursement of certain impact
fees collected in amounts of $100.00 or less by waiving
the refund procedures and the application fee required
under Ordinance No. 76-1.
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: The terms and conditions of
Ordinance No. 76-1 are hereby waived as pertains to
the reimbursement of certain impact fees collected
under Ordinance 73-55 in amounts of $100.00 or less
and are hereby replaced by the following conditions:

A. Application shall be
made for reimbursement to the office of the City
Manager on a form to be prescribed by said office.
B. There shall be no
application fee for consideration of the reimbursement.
C. Said application shall be
reviewed administratively by the City Manager, City
Attorney, Finance Director, and Chief Building Official.
SECTION 2: That after review of the
application and a determination that the reimbursement
therein is accurate, the City Manager is hereby autho-
rized to issue a reimbursement of the requested fees.
SECTION 3: Should any section or provision
of this Ordinance or any portion thereof, or any para-
graph, sentence or word be declared by a Court of
competent jurisdiction to be invalid, such decision
shall not affect the validity of the remainder hereof
as a whole or any part hereof other than the part
declared to be invalid.
SECTION 4: This Ordinance shall become
effective immediately upon its final passage.
