CITY OF TAMARAC, FLORIDA
ORDINANCE No. �3
AN ORDINANCE AMENDING ARTICLE XX11, DIVISION
2, SPECIAL EXCEPTION SECTION 28-197 OF THE
TAMARAC CITY CODE BY INCLUDING THER= ADDI-
TIONAL USES REQUIRING SPECIAL EXCEPTIONS IN
SPECIFIC ZONING DISTRICTS AND PROVIDING
SPECIAL EXCEPTION FOR ALL ADDITIONAL USES IN
B-1, B-2 AND B-3 ZONING DISTRICTS WHICH ARE
NOT DESIGNATED IN ANY BUSINESS DISTRICT;
REPEALING ALL ORDINANCES IN CONFLICT; PRO-
VIDING A SAVINGS CLAUSE; PROVIDING AN EFFEC-
TIVE DATE.
WHEREAS, THE Planning Commission of the City of Tamarac, Florida.
has been directed by the City Council to review the City of Tamarac's Zoning
Code and Ordinances; and
WHEREAS, THE Planning Commission of the City of Tamarac, Florida
has recommended to the City Council of the City of Tamarac that certain business
uses be allowed as a special exception in specific zoning districts.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That Article XX11,Division 2, Special Exception, Section
28-197 of the Tamarac City Code, is hereby amended to read as follows:
A. "The following buildings, structures and uses may be
approved by the City Council as special exceptions in
the districts permitted in part B, except as otherwise
provided, in accordance with the procedures and stand-
ards of Section 28-199 of the Tamarac City Code and
provided that the public health, safety, morals and
general welfare will not be adversely affected; that
it conforms to all City Ordinances unless otherwise
specified in this division, or specified as a condition
of approval the height limits, yard spaces, lot area
and other applicable regulations shall be the same as
for the other uses in the district in which the special
exception is located."
B. SPECIAL EXCEPTION USES PERMITTED IN SPECIFIC DISTRICTS
- (a) Aeroplane -Ground Schools; B-3 zoning district
(b) Alcoholic Beverages; B-1, B-2 and B-3 zoning districts
(c) Ambulance Service; B-1, B-2 and B-3 zoning districts
(d) Amusement Centers; B-1, B-2 and BW-3 zoning districts
(e) Athletic Club Indoors; B-1, B-2, B-3, M-1, M-2, R-0
and R-OA zoning districts
(f) Carnivals; B--3, M-1,.M 2 and A-1 zoning districts

(g) Circuses; B-3, M-1, M-2 and Ar-1 zoning districts
(h) Funeral Homes; B-1, B-2, B-3, RO and RO-A zoning districts
(i) Gasoline Service Stations; B-2 and B-3 zoning districts
(j) Halls for Hire; B-2 zoning districts
(k) Hospitals; B-1, B-2, B-3, R-0 and R-OA zoning districts
(1) Landscape Nursery; B-2, M-1, M-2 and A-1 zoning districts
(m) Motorcycle sales and service; B-2 zoning districts
(n) Nursing or Convalescent Homes; B-2, B-3, R-0, R-OA
and R-4A zoning districts
(o) Outdoor Recreation (tennis courts, public swimming
pools); B-2, R-0 and R--OA, M-1 and M-2 zoning districts
(p) Water and Waste Treatment Plant; B-3, M-1 and M-2
zoning districts
(q) Commercial banks; B-1 and R-0 zoning districts; (the
parcel area shall be a minimum of 40,000 square feet
in a freestanding building)
C. GENERAL SPECIAL EXCEPTION
All additional uses not specifically designated in the Master
Business Uses (Sec. 28-171) may be granted as Special Exception
in B-1, B-2 and B-3 business districts provided the applicant
adheres to the procedures set forth in Section 28-199.
SECTION 2: Should any section or provision of this Ordinance or
any portion hereof or any paragraph, sentence or word be declared by a
Court of competent jurisdiction to be invalid, such decision shall not
affect the validity of the remainder hereof as a whole or any part hereof
other than the part declared to be invalid.
SECTION 3: All Ordinances or parts of Ordinances in conflict
herewith be and the same are hereby repealed, as of the effective date
of this Orddnance.
SECTION 4: This Ordinance shall become effective immediately upon
its final passage.
