CITY OF TAMARAC, FLORIDA
ORDINANCE NO. 7&- 3-3
AN ORDINANCE SUPPLEMENTING CHARTER,
SECTION 6.06, PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the City of Tamarac, Florida,adopted, by
referendum, a revised Charter, effective at noon on March
15, 1976, and
WHEREAS, pursuant to Article VI, QUALIFICATIONS AND
ELECTION, Section 6.06, (Candidates) of said Charter the
Council desires to supplement said Section 6.06, by providing
as follows:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF TAMARAC, FLORIDA.
SECTION 1: Section 6.06 -- Candidates
"Any elector
resident of the City may
be a candidate for the
office of Mayor and any
elector resident of
the City who resides within
the territorial boundaries
of a district, may be
a candidate for the
office of councilmember for
that district. Each
candidate shall file a verified
notice of candidacy
in such form as may be required
by law with the City
Clerk, and pay such fees as may
be required by law,
no earlier than noon on the last
Tuesday in January,
nor later than noon on the second
Tuesday in February
of the calendar year in which the
election is to held."
SEC",TTON 2:
Candidates for the office of Mayor and Councilmember
shall be nominated by the filing of a written petition with
the City Clerk in the following manner:
(1) Form and Content of Nominating Petitions.
All papers of a nominating petition to be supplied by the City
Clerk shall be uniform in size and style, shall be in a form
designated by the City Clerk, and shall be assembled as one
instrument for filing.

(2) Sponsors. Candidates for the office of Mayor or
Councilmember shall be nominated by the filing of a written
petition with the City Clerk in the following manner:
Any resident qualified elector of the City may be
nominated for the office of Mayor or Councilmember by the
filing of a written petition of one hundred (100) electors
of the City, who shall be designated as his sponsors. Not
more than 50 such electors shall reside in the district of
the candidate. The signatures on a nominating petition need
not be all affixed to one paper, but to each separate paper
of a petition, there shall be attached an affidavit executed
by its circulator stating the number of signers of the paper,
that each signature was affixed in his presence and that he
believes it to be the genuine signature of the person whose
name it purports to be.
An elector (a) may sign one nominating petition for
each office to be filled at an election, and an elector who
signs more shall have all his signatures declared invalid;
(b) no elector shall sign more than one petition for a
particular candidate for the office of Mayor or Councilmember,
and if an elector signs more than one, his signature shall be
counted only once.
The signatures shall be executed in ink or indelible
pencil. Each signer shall be a resident, registered elector
and shall indicate next to his signature the date of his
signing and the place of his residence, giving the street and
number or other description sufficient to identify it. The
signed petitions shall be filed with the City Clerk no earlier
than noon on the last Tuesday in January nor later than noon
on the
second Tuesday in February of
the calendar year in
which
the election is to be held. As
regards a special election
under
the provisions of Section 4.05
(C) and (D) the signed
petitions
shall be filed no earlier
than noon on the day six
weeks
prior to, nor later than noon
on the day four weeks prior

to the date set for the special election. The City Clerk
shall give a receipt therefor.
(3) Acce tance Qualifying Fee. No nominating petition
shall be accepted until the candidate has paid to the City
Clerk
a qualifying fee
of twenty-five ($25.00) dollars
for
Mayor
and ten ($10.00)
dollars for Councilmember, plus
a fee
of .10� per signature on the nominating petition to defray the
cost of certification of same by the County Supervisor of
Elections. The nominating petition shall be accompanied by
a signed statement of acceptance of the nomination to be
supplied by the City Clerk, which acceptance shall state that
if elected, that person will qualify and serve in such office
during the term for which he is elected. The City Clerk shall
deliver to such candidate a dated, written receipt for said
acceptance statement and qualifying fee. Payment of said fee
and filing of acceptance must be done and completed no earlier
than noon on the last Tuesday in January nor later than noon
on the second Tuesday in February of the calendar year in which
the election is to be held. As regards a special election under
the provisions of Section 4.05 (C)and (D) the payment of fee
and filing of acceptance must be done no earlier than noon on
the day six weeks prior to, nor later than noon on the day four
weeks prior to the date set for the special election.
(4) Procedure After Filing. Within three days after
the filing of the nominating petition, the City Clerk shall
notify the candidate whether or not his petition satisfies the
requirements prescribed by this Charter. If a petition is
found insufficient, the City Clerk shall return it immediately
to the candidate with a statement certifying wherein it is
found insufficient. Within the regular time for filing petitions,
such a petition may be amended and filed again as a new petition
or a different petition may be filed for the same candidate.
The City Clerk shall keep on file all petitions found sufficient

at least until the expiration of the term for which the
candidates are nominated in those petitions.
SECTION 3: Candidates for the office of Charter
Board shall file notice of intention to run on a form desig-
nated by the City Clerk and shall remit therewith a qualifying
irfee of ten ($10.00) dollars.
SECTION 4: This Ordinance shall become effective
immediately upon its final passage.
