HomeMy WebLinkAboutCity of Tamarac Ordinance O-1976-043Introduced By: 0l M �h C_, Proposed By: Q �"` G GQ•� Temp. # :Z CITY OF TAMARAC, FLORIDA ORDINANCE NO.--2Q: AN ORDINANCE AMENDING SECTION 27 OF THE TAMARAC CITY CODE BY ADDING THERETO NEW PARAGRAPHS 20 AND 21; ESTABLISHING A REQUIREMENT FOR THE INSTALLATION OF WATER METERS AT RESIDENTIAL PROPERTIES AND CLUBHOUSES IN THAT PORTION OF THE CITY OF TAMARAC RECEIVING WATER FROM FORT LAUDERDALE UTILITIES; PROVIDING FOR RATES TO BE CHARGED FOR INSTALLATION OF WATER METERS, DEPOSIT, AND MONTHLY WATER SERVICES; REPEALING ALL LAWS IN CONFLICT; PROVIDING A SAVINGS CLAUSE AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Council has made a legislative finding based upon recommendation of the City Manager and Finance Director, at the time of adoption of the 1976-77 Utility Fund Budget, that it would serve the best interest of the City of Tamarac and the residents in the area of the City of Tamarac, receiving water from Fort Lauderdale Utilities, to institute a program to meter water service at residential units and clubhouses within that area, and to establish a rate structure to be charged for the installation of water meters, deposit, and monthly water service. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That Section 27 of the Tamarac City Code is hereby amended, by adding thereto the following paragraphs: Section 27-20. Requirements for Installation of Water Meters. Effective October 1, 1976, a program for the installation of water meters at residential properties and clubhouses in the area of the City of Tamarac receiving water from Fort Lauderdale Utilities, is hereby instituted as follows: a) All clubhouses in the area defined, shall install water meters in accordance with a program to be developed by the office of the City Manager. b) All residential properties in the area defined, shall have meters installed upon the sale and transfer of deed from any current property owner, as of October 1, 1976, to a subsequent property owner. Such installation shall be required prior to the renewal of water services to the residential unit for the new property owner. c) All unimproved properties at the time of develop- ment and prior to issuance of a Certificate of -I- I 1 I Occupancy shall have a water meter installed. Section 27-21. The Rates For Installation of Meters, Deposit, and Monthlv Water Service. All residential properties and clubhouses in the area of the City of Tamarac, receiving water from Fort Lauderdale Utilities, shall be charged for meter installation, deposit, and water service, in accordance with the following schedule: a) Installation of water meters ... $150.00 b) Deposit ... $25.00 c) Monthly rates: 0 -- 5,000 gallons ... $4.00 Over 5,000 gallons, for each additional 1,000 gallons ... $.88 per 1,000 SECTION 2: Should any section or provision of this Ordinance or any portion thereof, or any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not effect the validity of the remainder hereof as a whole or any part hereof other than the part declared to be invalid. SECTION 3: All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: This Ordinance shall become effective immediately upon its final passage. PASSED FIRST READING this 13 day of 1976.
