AN ORDINANCE REPEALING ORDINANCE #75-10 OF THE CITY OF TAMARAC AND PROVIDING FOR REVISED COURT COSTS IN THE MUNICIPAL COURT OF THE CITY AND THE ALLOCATION AND DIS- BURSEMENT OF SAID COURT COSTS. WHEREAS, the City Council has heretofore by Ordinance #75-10, adopted provisions for Court costs in the Tamarac Municipal Court, and WHEREAS, the City Council deems it wise and expedient to establish new provisions for the allocation and disbursement of Court costs to defray the costs and expenses of the operation and maintenance of the Municipal Court. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: Court costs to be charged by the Municipal Court of the City shall be in the sum of Ten Dollars ($10.00) to be charged as a cost against each Defendant convicted in the Municipal Court of the City. Any costs assessed by any govern- mental agency shall be in excess of the charge designated herein. Said charge shall be rendered against each Defendant appearing and adjudicated guilty in the Municipal Court. SECTION 2: A penalty shall be assessed against those Defendants who admit guilt to a traffic violation, do not pay the fine, and fail to appear in Court on the scheduled date. A late fee of $10 shall be added to the fine to cover additional administrative costs. SECTION 3: With the exception of such cases where a person is convicted of violating a State Statute, City of Tamarac or Broward County ordinance related to parking of vehicles, in addition to the court costs set out in Sections 1 and 2 hereof there shall be charged by the Municipal Court of the City the additional sum of $2.00 to be charged as costs against each defendant con- victed in the Municipal Court of the City and said court costs shall be allocated and disbursed as follows: a. One dollar ($1.00) shall be allocated and disbursed to the State Treasurer of the State of Florida to be credited to the General Revenue Fund of the State of Florida. b. One dollar ($1.00) shall be allocated and disbursed to a special fund in the City of Tamarac to be used for law enforce- ment education expenditures for the Tamarac Police Department. SECTION 4: In addition to the court costs set out above, in the case of every bond estreature or forfeited bail bond in the City of Tamarac one dollar ($1.00) thereof shall be forwarded to the State Treasurer of the State of Florida for credit to the General Revenue Fund of the State of Florida. SECTION 5: That the court costs set out in paragraphs 3 and 4 hereof are charged and assessed in accordance with the provisions of Florida State Statute #943.25 (3) and (5). SECTION 6: All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed, and specifically Ordinance #75-10. SECTION 7: Should any section or provision of this Ordinance or any portion thereof, or any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be invalid.
