HomeMy WebLinkAboutCity of Tamarac Ordinance O-1976-087Temp. #448 PROPOSED BY: Revised 11/24/76 '^ n� Revised 12/22/76 INTRODUCED BY: � � �� `C.� CITY OF TAMARAC, FLORIDA ORDINANCE NO. #76-87 AN ORDINANCE AMENDING CHAPTER 28, ARTICLE THREE (3) OF THE CODE OF THE CITY OF TAMARAC, SO AS TO PROVIDE THAT THE TERMS OF THE MEMBERS OF THE PLANNING COMMISSION SHALL EXPIRE ON APRIL 15th OF THE APPROPRIATE YEAR: AND TO PROVIDE FOR THE DESIGNATION OF ALTERNATE MEM- BERS: AND PROVIDING AN EFFECTIVE DATE. WHEREAS, it has been determined by the City Council that it is in the best interest of the City that the terms of the regular members of the Planning Commission shall expire on April 15, of the appropriate year; and WHEREAS, the City Council is determined that it is in the best interest of the City that five (5) or less alternate members be designated for terms of one (1) year to expire on April 15th. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: Section 28-19. Created; composition; terms of members; powers and duties generally; meetings; election of officers; quorum. There is hereby created a Planning Commission consisting of five members, each of whom shall serve for a term of two years; except, that three of the first five members of such commission shall be appointed for a term of one year, so that the terms of the members may be staggered, and shall expire on April 15 of the appropriate year. The Council shall appoint no more than five (5) alternate members to serve for a term of one year expiring April 15, and in the absence of inability of any regular member of the Planning Com- mission to serve, then such alternate as may be requested by the Chairman of the Planning Commission shall thereupon serve in the place of said regular member with all the powers and duties as are vested in the regular member. (1) rrr�rr� SECTION 2: Severability Clause. Should any rL section or provision of this ordinance or any portion hereof, or any paragraph, sentence, or word be declared by a court of com- petent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part to be declared invalid. SECTION 3: Conflict. All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed, as of the effective date of this ordinance.
