CITY OF TAMARAC, FLORIDA
ORDINANCE NO. 76-9
AN ORDINANCE CREATING A MORATORIUM ON
THE ISSUANCE OF BUILDING PERMITS IN THAT
SUBDIVISION KNOWN AS WESTWOOD COMMUNITY
VI, SECTION 24, SAID SUBDIVISION SITUATE,
LYING AND BEING WITHIN THE CORPORATE LIMITS
OF THE CITY OF TAMARAC, COUNTY OF BROWARD,
FLORIDA; PROVIDING FOR CRITERIA TO BE USED
FOR TERMINATION OF THE SAID MORATORIUM PRO-
VIDING AN EFFECTIVE DATE; AND DECLARING AN
EMERGENCY.
WHEREAS, the City Engineer has furnished engineering
evidence that defective drainage conditions exist in Section
24 of the City, known as Westwood Community VI, and
WHEREAS, these conditions have existed for a long
period of time, and
WHEREAS, these conditions have not been corrected
and that the continuance of such drainage conditions are
prejudicial to the health, safety and welfare of the
residents of said Section, and
WHEREAS, that standards for correction of said
defective drainage conditions have been promulgated by
said City Engineer and approved by Council, and
WHEREAS, Council finds that further construction
of new homes in this section would compound a dangerous
condition and that as a result thereof an emergency exists
which requires the adoption of this Ordinance as an emergency
pursuant to Chapter 166.041, Section (3)(b) of the Florida
Statutes.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That no building permits be
issued with respect to property located in Section 24,
Westwood Community VI, of the City of Tamarac until such
time as corrective measures are taken to correct the
existing drainage defects and drainage conditions are no
longer prejudicial to the health, welfare and safety of
the residents of said section.
SECTION 2: The specific standards for
correction of said defective drainage conditions are

SECTION 3: This moratorium shall remain in
full force and effect for such period of time as is necessary
to correct the defective drainage conditions, by augmenting
the existing drainage system in Section 24, in accordance
with the standards set forth herein.
SECTION 4: The Council finds that an
emergency exists which is of great public concern affecting
the general welfare, health and safety of the citizens of
Tamarac, by reason of the potential harm and damage resulting
from a rainfall of intensity and duration even below the

design storm minimum criteria issued by the Florida State
Road Department and used by the Broward County Engineering
Department's office of Water Resources causing flooding as
a result of the existence of defective drainage within Section
241, Westwood Community VI, and finds that further construction
of new homes, would compound a serious and dangerous condition.
SECTION 5: This Ordinance shall take effect
immediately upon passage and dispensing with the requirements
for a second reading hereof.
