HomeMy WebLinkAboutCity of Tamarac Ordinance O-1980-002Introduced by V/M Massaro Temp. # 709 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 ["IVy r)MgmF.'I:� Malto) asr7.1 ORDINANCE NO, 0-80-2 AN ORDINANCE PLACING ON THE BALLOT OF MARCH 11, 1980, A PROPOSED AME=NT TO SECTION 7.03 OF THE TAMARAC CITY CHARTER BY MODIFYING BUDGET REQUIREMENTS AND ESTABLISHING LIMITS ON UNAPPROPRIATED SURPLUS AND ON CONTINGENCY ACCOUNTS; PROVIDING THAT IF THE QUESTION IS APPROVED BY A MAJORITY OF THE VOTERS AT THE MARCH 11, 1980 ELECTION IT SHALL BECOME AN AMENU�ENT TO THE CHARTER UPON CERTIFICATION AND ACCEPTANCE OF THE ELECTION RESULTS; PROVIDING FOR SEVERABILITY OF INVALID PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORID: SECTION 1:_ That the following question is to be presented to the electorate of the City of Tamarac at its March 11, 1980 election and if the following question is approved by a majority of the electorate at said election it shall become an amendment to the City Charter. Question 3 Shall Section 7.03 of the Tamarac City Charter be amended to limit the unappropriated surplus which the City may maintain, to limit the amount of money that may be maintained in General Fund Contingency Accounts, and to modify the City's Budget requirements? If this question is approved, the words, number and punctuation that are underscored will be added and the words, numbers and punctuation that are struck through will be deleted. Section 7.03 - Form and Content of Budget and Limitation on Un- r riated S lus The. General Fund budget shall be presented on an accrual basis for expenditures and on a modified accrual basis for revenues, and shall provide a complete financial plan of all funds and activities for the ensuing fiscal year, and shall contain such details and be in such form as may be required by law and by the Council. Also, it shall show comparative figures of expenditures and revenues for the current and past fiscal year detailed to show the increase and decrease in dollars and percentages. The total of estimated expenditures shall not exceed the total of estimated revenue and appropriated fund balance. It shall also show projected fixed expenses for the next five (5) years and expenses for pensions, if any, and debt service. No more than five (5%) percent of expenditures of the General Fund budget'may be included in the budget for contin encies that may not have been included or which may have been underestimated in the proposed expenditures. This figure does not include unappropriated surplus. The City shall ado t formal bud ets for all other Funds when it deems suchbudgeting to be consistent with Generally Accepted Accounting Principles or when required by law. SECTION 2: If the question is approved by a majority of the voters of the City of Tamarac at the March 11, 1980 election it shall be effective as an amendment to the Tamarac City Charter upon certification by the Broward County Canvassing Board and acceptance of the certification by the City Council. SECTION 3: Should any section or provision of this ordinance or any portion hereof or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof other than the part declared to be invalid. SECTION 4: This ordinance shall become effective immediately upon its adopt ion, and the appropriate City officials are authorized to take whatever actions are necessary to see that these matters are placed on the March 11, 1980 ballot.
