2 ORDINANCE NO. - #00 - 3
3 AN ORDINANCE PLACING ON THE BALLOT OF MARCH 11,
1980, PROPOSED AMENDMENTS TO THE CHARTER OF THE
4 CITY OF TAMARAC, AMENDING THE FOLLOWING SECTIONS
OF THE TAMARAC CITY CODE:
5 SECTION 4.04 - BY CHANGING THE PROVISION PER-
TAINING TO COMPENSATION AND EXPENSES OF MAYOR AND
6 COUNCIL, AND
SECTION 6.03 - AMENDING THE REDISTRICTING PROCESS;
7 PROVIDING THAT EACH QUESTION IS TO BE CONSIDERED
SEPARATELY; PROVIDING THAT EACH QUESTION APPROVED
8 BY A MAJORITY OF THE VOTERS AT THE MARCH 11, 1980
ELECTION SHALL BECOME AN AMENDMENT TO THE CHARTER
9 OF THE CITY OF TAMARAC UPON CERTIFICATION AND
ACCEPTANCE OF THE ELECTION RESULTS; PROVIDING FOR
1.0 SEVERABILITY OF INVALID PROVISIONS; AND PROVIDING
AN EFFECTIVE DATE.

12 WHEREAS, the City's Charter Board and Council have suggested amendments
13 to various provisions in the City Charter; and
14 WHEREAS, hearings have been conducted concerning Charter amendments by
15 both the City Council and by the Charter Board.
16 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
17 TAMARAC, FLORIDA:
18 SECTION 1: That the following questions are to be presented separately
1 9 to the electorate of the City of Tamarac at its March 11, 1980, election and any
20 of the following questions which are approved by a majority of the electorate at
21 said election shall become an amendment to the City Charter:
22 Question 1. Shall Section 4.04 of the Tamarac City Charter be
23 amended to provide that the expenses of the Mayor and Council shall not
24 exceed three thousand ($3,000.00) dollars and two thousand ($2,000.00)
25 dollars respectively with computation on an elected year basis?
26 If this question is approved, the words that are struck through will
27 indicate the deletions and the underscored words will indicate the new language.
28 Section 4.04 - Compensation and Expenses of Mayor and Council
29 The salary of the Mayor shall be $150.00 per month and the salary of the
30 lCouncil members shall be $100.00 per month. Geiel

1 The Mayor shall be entitled to receive his
2 actual and necessary expenses allowable by law, not to exceed three thousand
3 $3,000.00) dollars per year incurred in the performance of his duties as Mayor
4 upon delivery_of an itemized voucher to the City Manager.
5 Eaci Council member (other than Mayor) shall
6 be entitled to receive his actual and necessary expenses allowable by law, not
7 to exceed two thousand ($2,000.00) dollars per year incurred in the performance
8 of his duties duties as Councilmember upon delivery of an itemized voucher to the City
9 Manager.
10 Expense limitations for the Mayor and Council shall be calculated per
11 elected year._
1 2 Question 2. Shall Section 6.03 of the Tamarac City Charter
13 pertaining to redistricting be amended to provide for the redistricting
14 process to be undertaken in 1982 and every five years thereafter with
15 an uncompensated Redistricting Committee?
36 If Question 2 is approved, Section 6.03 would be largely revised and
17 would read as follows:
18 Section 6.03 - Redistricting.
19 A Redistricting Committee shall be appointed as a board for possible
20 redistricting during 1982 and every five (5) years subsequent, consisting of at
21 least five (5) public members, one (1) member of the City Council and one (1)
22 member of the Charter Board. Two (2) public members shall be appointed by the
23 City Council. Two (2) public members shall be appointed by the Charter Board.
24 One (1) public member shall be appointed by the four (4) previously appointed
25 public members. The one (1) City Council member shall be appointed by the City
26 Council. The one (1) Charter Board member shall be appointed by the Charter Board.
27 The Committee shall be appointed by May 1st each year that redistricting is to be
28 considered. The Committee shall elect its own Chairman from among the public
29 members.
30 The redistricting process shall commence two (2) weeks after the Committee
31 for redistricting has been appointed. The report of the Committee shall include a
32 piap and description of the districts recommended and shall be delivered to the City
33
ouncil
by July 15th
of the year that
redistricting
is being considered. Members

SECTION 2: Each question shall be considered separately and each
question approved by a majority of the voters of the City of Tamarac at the
March 11, 1980 election shall be effective as an amendment to the City Charter
upon certification by the Broward County Canvassing Board and acceptance of the
certification by the City Council.
SECTION 3: Should any section or provision of this ordinance or any
portion hereof or any paragraph, sentence or word be declared by a Court of
competent jurisdiction to be invalid, such decision shall not affect the
validity of the remainder hereof as a whole or any part hereof other than the
part declared to be invalid.
SECTION 4: This ordinance shall become effective immediately upon its
adoption, and the appropriate City officials are authorized to take whatever
actions are necessary to see that these matters are placed on the March 11, 1980,
ballot.
