ORDINANCE NO. Q-- O -/0
AN ORDINANCE AMENDING SECTION 18-8 OF THE TAMARAC CITY
CODE PERTAINING TO ENFORCEMENT OF HANDICAP PARKING
REQUIREMENTS BY INCREASING PENALTY FOR VIOLATIONS;
PROVIDING FOR CODIFICATION; PROVIDING REPEALER; PROVIDING
SEVERABILITY OF INVALID PROVISIONS; AND PROVIDING AN
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF'TAMARAC, FLORIDA:
SECTION 1: Section 18-8 of the Tamarac City Code by adding
the words, numerals and punctuation underscored and deleting the words, numerals
and punctuation struck through as follows:
Sec. 18-8. Same —Enforcement.
(a) Infraction. Any unauthorized person parking in a handicapped space is guilty
of a traffic infraction.
(b) Ticketing Procedure. Vehicles parked in violation of section 18-7 shall be
ticketed by the police department, said ticket to be affixed to the windshield of the
offending vehicle. The owner or operator of said vehicle shall appear at the police
department within seventy-two (72) hours and pay a penalty in accordance with the
schedule listed in subsection'(c).
(c) Penalty. A charge of €4ve-del4ars4 $6-994 fifteen dollars $15.00
shall be assessed for the first violation of section 18-7. Any repeat
violation by the same owner, however, shall be assessed as follows:

In the event of failure of the owner or operator to pay such penalty as set forth above,
an officer of the police department shall issue a citation and notice to appear.
(d) Refusal To Accept and Sign Citation or Notice To Appear. Any person who
willfully refuses to accept and sign a citation or notice to appear issued pursuant to
this section shall be guilty of a separate violation, and that person may be arrested by
any law enforcement officer of the city.
(e) Failure or Refusal To Pay Penalty. It shall be unlawful for any person to refuse
or fail to pay any penalty assessed for a violation of section 18-7, and that person
shall be guilty of a separate violation. A penalty of not more than five hundred dollars
($500.00) shall be assessed against any person who shall refuse or fail to pay a penalty
assessed for violation of section 18-7.
SECTION 2: Specific authority is hereby granted to codify this Ordinance.
SECTION 3: All ordinances or parts of ordinances in conflict herewith
are repealed to the extent of such conflict.

portion hereof or any paragraph, sentence or word be declared by a Court of
competent jurisdiction to be invalid, such decision shall not affect the
validity of the remainder hereof as a whole or any part hereof other than the
part declared to be invalid.
SECTION 5: This ordinance shall become effective immediately upon
its final passage.
