AN ORDINANCE AMENDING SECTION 20-42 OF THE TAMARAC
CITY CODE PERTAINING TO PARK AND RECREATION SITE
ACQUISITION AND DEVELOPMENT REQUIREMENTS FOR
PARCELS BEING PLATTED BY ESTABLISHING A FORMULA
FOR DETERMINING THE AMOUNT OF CASH PAYMENTS IN
LIEU OF PARK DEDICATION FOR RD-7 ZONING DISTRICTS,
BY INCREASING LAND DEDICATION REQUIREMENTS FOR PARK
DEDICATIONS IN R-3 AND IN R-4A ZONING DISTRICTS,
BY ELIMINATING THE OPTION OF DEDICATING LAND TO
FUTURE RESIDENTS OF A SUBDIVISION FOR USE WITHIN
THAT SUBDIVISION IN LIEU OF DEDICATIONS DIRECTLY
TO THE CITY OR PAYMENTS OF CASH DIRECTLY TO THE
CITY, AND BY SPECIFICALLY PERMITTING THE CITY COUNCIL
TO REJECT PROPOSED LAND DEDICATION AND REQUIRE CASH
PAYMENTS UNDER CERTAIN CONDITIONS; INCREASING LAND
DEDICATION REQUIREMENTS FOR SUBDIVISIONS WITH
DENSITY OF NINE UNITS OR MORE PER ACRE; PROVIDING
NO CREDIT FOR REQUIRED WATER RETENTION; PERMITTING
PARTIAL CREDIT FOR CERTAIN RECREATION WATER
FACILITIES; PROVIDING FOR CODIFICATION; PROVIDING
REPEALER; PROVIDNG FOR SEVERABILITY OF INVALID
PROVISION; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:
SECTION 1: Section 20-42 of the Tamarac City Code is amended
by adding the words, numerals and punctuation underscored, and by
deleting the words, numerals and punctuation struck through as follows
Sec. 20-42. Generally.
(a) Dedication of land or cash payment of fees in lieu thereof.
No final subdivision plat shall be approved nor shall a building
permit be issued in connection therew4!th with the property covered^
by the 12lat unless land has been dedicated to the city for park,
playground, recreational or other purposes, or a cash payment has
been made in lieu thereof, or some combination of dedication and
payment has been made as hereinafter set forth.
(b) Land to be dedicated. The portion of land required to be
dedicated for park and recreation purposes shall be established in
accordance with the following table:

(G) Application of table formulas. The planning-eemmtsslen
C,_ity_ shall require the subdivider to dedicate land or make cash pay-
ments in lieu of land dedication in accordance with the table formulas
set forth in subsection (b) and (d) of this section, as appropriate,
based upon the maximum gross density permitted within the zone in which
the subdivision is located. However, where a subdivider proposes to
develop land at less than the maximum density permitted for the zone
and has executed and recorded in the
Public Records of Broward County a covenant reviewed by the City
Attorney, and approved by the City Council, binding upon all future
owners that such land shall not be developed to a higher density than
that proposed, the planning-eernmisslen City shall base the required
dedication or payment upon such proposed density.
(d) Cash payment in lieu of dedication. In lieu of the
dedication of a portion of or all of the land hereinabove set forth,
the City shall require a cash payment to it which shall be computed on
the following basis:
(1) R-lB or R-lC zoning classification at thirty thousand
dollars ($30,000.00) per acre.

{3} (1) No land shall be required to be dedicated and no cash
1payments shall be required to be paid for any property zoned and used
(for commercial', industrial, agrricultura _ l excavation, and agricultural
(purposes.
44} (2) Where any subdivision contains five (5) acres or less
for where less than one and one-half acres is proposed to be dedicated,
only a cash payment shall be regaired Eermitted. The City Council may
reject proposed land dedications and require a cash Davment in lieu of
land when the proposed site is not a22rO2riate for ark or recreational
use due to its location, configuration, access by residents of the Cit ,
topography or any other reasonable standard established by the Citv
Council.
(3) No credit for 2ark, playground or recreational purposes
shall be allowed for required water retention provided pursuant to the
rovisions of Ordinance No.80--26 as the same may be amended from time
to time. However, Council may allow credit for u
to, but not in excess
of one half of the amount of land used for recreational water pur oses.
No credit shall be allowed for canals or drainage waterways.
SECTION 2: Specific authority is hereby granted to codify this
ordinance.
SECTION 3: All ordinances or parts of ordinances in conflict
herewith are repealed to the extent of such conflict.
SECTION 4: Should any section or provision of this ordinance or
any portion hereof or any paragraph, sentence or word be declared by a
court of competent jurisdiction to be invalid, such decision shall not
affect the validity of the remainder hereof as a whole or any part
hereof other than the part declared to be invalid.
SECTION 5: This ordinance shall become effective upon its final
passage.
