D- go-& % AN ORDINANCE ESTABLISHING A SPECIAL LAW ENFORCEMENT TRUST FUND AS AUTHORIZED WITHIN SECTION 943.44 OF THE FLORIDA STATUTES WHEREIN MONIES OBTAINED THROUGH THE SALE OF CONTRABAND MAY BE USED FOR SPECIFIC LAW ENFORCEMENT PURPOSES; SETTING FORTH PURPOSES FOR WHICH MONIES MAY BE EXPENDED; PROVIDING FOR CODIFICATION; PROVIDING REPEALER; PROVIDING FOR SEVERABILITY OF INVALID PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1:' FINDING OF FACT Section 943.44 of the Florida Statutes authorizes the sale of contraband as defined within the Florida Statutes confiscated by a municipal police force wherein title has been perfected by the Circuit Court. This Statute requires proceeds to be deposited in a Special Law Enforcement Trust Fund and be used for Law Enforcement purposes only. This ordinance is intended to provide the implementing authority for the above mentioned statute within the City of Tamarac. This ordinance does not affect the right of the City to keep the contraband article after title has been perfected as authorized in applicable State Statutes if it so elects. SECTION 2: There is hereby created a Special Law Enforcement Trust Fund as authorized within Section 943.44 of the Florida Statutes as the same may be amended from time to time. Monies to be deposited into said fund shall be those monies obtained through the sale of contraband or cash obtained within the definition of contraband when ownership has been perfected in the name of the City of Tamarac t•rlelT7AK1 1 _ Monies in the Special Law Enforcement Trust Fund may be expended only for Law Enforcement purposes and those purposes shall include, without limitation, the costs of protracted or complex investigations, the provision of additional technical equipment or expertise, the provision of matching funds to obtain federal grants, or for other Law Enforcement purposes which the City Council may deem appropriate. This fund shall not be considered a source of revenue to meet normal operating needs and neither the City of Tamarac nor any of its departments or agencies shall anticipate future forfeitures of proceeds therefrom in the adoption and approval of the budget for the Tamarac Police 35 Department. 36 SECTION 4: Specific authority is hereby granted to codify this ordinance. SECTION 5: All ordinances or parts of ordinances in conflict herewith are repealed to the extent of such conflict. SECTION 6: Should any section or provision of this ordinance or any portion hereof or any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof" other than the part declared to be invalid.
