AN ORDINANCE DEFINING ALCOHOLIC BEVERAGES AND MAKING IT UN- LAWFUL TO CONSUME SUCH ALCOHOLIC BEVERAGES UPON PUBLIC STREETS, HIGHWAYS OR SIDEWALKS OR UPON PARKING AREAS ADJACENT TO ESTABLISHMENTS LICENSED FOR THE SALE OF ALCOHOLIC BEVERAGES OR UPON THE PREMISES OF ANY ESTABLISHMENTS NOT .LICENSED FOR THE SALE OF ALCOHOLIC BEVERAGES FOR CONSUMPTION ON THE PREMISES; MAKING IT UNLAWFUL FOR ALCOHOLIC BEVERAGE VENDORS OR THEIR AGENTS TO SELL, SERVE. OR DISPENSE ALCOHOLIC BEVERAGES TO PERSONS UPON OR KNOWINGLY PERMIT CONSUMPTION OF ALCOHOLIC BEVERAGES UPON ADJACENT PARKING AREAS; PROVIDING PENALTY; PROVIDING FOR SEVERABILITY; PROVIDING REPEALER AND SPECIFICALLY REPEALING SECTION 3-1 OF THE CITY CODE; PRO- VIDING FOR INCLUSION IN THE CODE; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY TAMARAC, FLORIDA: Section 1. DEFINITIONS 1.01 Alcoholic Beverage. Any beverage which contains more than one (1) percent alcohol by weight. 1.02 Establishment. Any place of business which has been licensed by the State of Florida for the sale of alcoholic beverages under the provisions of the Beverage Law (Chapters 561 through 568, Florida Statutes). Section 2. PROHIBITIONS 2.01 It shall be unlawful for any person to consume any alcoholic beverage upon any area available for use by the public for motor vehicle parking purposes, any public street, highway or sidewalk, where such area adjoins or is adjacent or appurtenant to any establishment within Tamarac where alcoholic beverages are sold or dispensed. 2.02 It shall be unlawful for any person to consume any alcoholic beverage on the premises of any establishment within Tamarac where such beverages are sold only for consumption off the premises. 2.03 It shall be unlawful for any person or for the officers, employees, servants or agents of any person, firm, association or corporation.licensed-by the State of Florida for the sale of alcoholic beverages for consumption either on or off the premises to (a) Sell, serve or dispense any alcoholic beverage to any person upon any motor vehicle parking area which is adjacent to or adjoining or appurtenant to any establishment within the City of Tamarac,Florida, licensed for the sale of alcoholic beverages, or; (b) Knowingly permit the consumption of any alcoholic beverage by any person upon any motor vehicle parking area which is adjacent to or adjoining or appurtenant to any establishment within City of Tamarac,Florida, licensed for the sale of alcoholic beverages. PENALTY 3.01 Any person convicted of violating any portion of this Ordinance shall be punished as provided by law. Section 4. SEVERABILITY 4.01 If any section, sentence, clause or phrase of this Ordinance is held to be invalid or unconstitutional by any Court of competent jurisdiction, then said holding shall in no way affect the validity of the remaining portions of this Ordinance. Section 5. INCLUSION IN CODE 5.01 It is the intention of the Tamarac City Council that the provisions of this Ordinance shall become and be made a part of the Tamarac City Code; and that the sections of this Ordinance may be renumbered or relettered and the word "ordinance" may be changed to "section", "article; or such other appropriate word or phrase in order to accomplish such intentions. Section 6. REPEALER 6.01 Section 3-1 of the Tamarac City Code is hereby Repealed. All ordinances and parts of ordinances, and all Resolutions or parts of Resolutions in conflict herewith are repealed to the extent of the conflict. Section 7. EFFECTIVE DATE 7.01 This Ordinance shall become effective upon adoption. PASSED FIRST READING this _day of , 1980. PASSED SECOND READING this day of , 1980.
