D -7�aIr 3 AN ORDINANCE AMENDING THE PENSION PLAN OF THE CITY OF TAMARAC AS INCORPORATED IN ORDINANCE NO. 77-13 4 AS AMENDED BY MODIFYING THE DEFINITION OF MEMBER IN SECTION II AND BY MODIFYING SECTION III OF SAID 5 PLAN TO REMOVE EMPLOYEES ENGAGED DIRECTLY BY THE CITY COUNCIL AND PERSONS EMPLOYED ON A CONTRACT 5 BASIS FROM SAID PLAN; PROVIDING FOR SEVERABILITY; PROVIDING REPEALER__;'AND PROVIDING AN EFFECTIVE DATE. 7 g WHEREAS, the Tamarac City Council realizes that employees engaged 9 directly by the City Council negotiate the terms and conditions of their employ-- 1 0 ment with the Council; and 11 WHEREAS, the number of said employees is small; and 12 WHEREAS, the City Council desires to provide those employees with 13 the option of not being included in the said Plan; and 14 WHEREAS, it has been determined by actuaries engaged by the City 15 that this amendment will not be detrimental to the overall Plan. ]6 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF 11 TAMARAC, FLORIDA: 18 SECTION 1: That Section II(f) of the Tamarac Pension Plan adopted 19 by Ordinance No. 77-13, as amended, is amended to insert the words, numbers and 20 punctuation underscored and delete the words, numbers and punctuation struck 21 through as follows: 22 (f) "Member" shall mean a General full time Employee, Police 23 Officer or Firefighter who fulfills the prescribed 24 participation requirements. Volunteer Employees shall be 25 excluded from membership. This term shall not include an' 26 em to ee en a ed directiv bv the Citv Council or persons 27 employed on a contractual basis. 28 SECTION 2: That Section III of the Tamarac Pension Plan, adopted 29 by Ordinance No. 77-13, as amended, is amended to insert the words, numbers and 30 punctuation underscored and delete the words, numbers and punctuation struck 31 through as follows: 32 SECTION III MEMBERSHIP; Each Employee, in the active 33 employment of the Employer as of June 1, 1975, shall become a 34 Member of the plan as of June 1, 1975. Any erson covered by the Plan on 2 / 13 / 8 0 1 _ , the effective date of this ordinance, shall have the option of electing to continue or discontinue participation, such' election shall be irrevocable. Rehired Employees, regardless of the period of previous employment with the City shall be considered as new Employees. Employees may be required to complete an application form if so requested by the Trustees. SECTION 3: Any payments made to date by any employee covered by this Ordinance who elects to opt out of this Plan shall be returned without interest. Employer contributions prior to the effective date of this Ordinance shall not be withdrawn from the Fund and shall remain a part of the Fund. SECTION 4: This amendment has been approved by an actuarial firm and said approval is attached hereto as Exhibit I. SECTION 5: Should any section or provision of this Ordinance or any portion hereof or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof other than the part declared 29 30 31 32 33 34 to be invalid. SECTION 6: All ordinances or parts of ordinances in conflict herewith are repealed to the extent of such conflict. SECTION 7: This ordinance shall become effective immediately upon its final passage.
