AN ORDINANCE SUPPLEMENTING SECTION 14-71 OF THE TAMARAC
CITY CODE PERTAINING TO ALARM SYSTEMS BY MAKING FAILURE
TO PAY ANY FINE OR FEE ESTABLISHED IN ARTICLE IX OF
SECTION 14 OF THE TAMARAC CITY CODE (ALARM SYSTEMS)WITHIN
A SPECIFIC PERIOD OF TIME�-.OF WHEN °IT IS DUE A SEPARATE
OFFENSE PI1.4ISHABLE BY A FINE NOT TO EXCEED $500;
INCARCERATION NOT TO EXCEED 60 DAYS OR ANY COMBINATION
OF FINE OR INCARCERATION; PROVIDING FOR CODIFICATION;
PROVIDING REPEALER; PROVIDING FOR SEVERABILITY; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1. Section 14-71 of the Tamarac City Code is amended
by adding the words, numbers and punctuation underscored and deleting the
words, numbers and punctuation struck through as follows:
Sec. 14-71. Penalties.
Anyone violating any provisions of this article shall be subject to
a penalty of not less than fifty dollars ($50.00) for each violation unless
otherwise provided for within this article.
If said payment is not made within thirty (30) days of date of
notice thereof the alarm system shall be disconnected.
The failure to pay any penalty or fee set forth in this Article within
30 days of.the date when due is a separate offense and a violation of the
City Code. It shall be punishable by a fine not to exceed $500, by incarceration
not to exceed 60 days or any combination of fine or incarceration. Each days
violation shall constitute a separate offense.
SECTION 2: Specific authority is hereby granted to codify this
this ordinance.
SECTION 3: All ordinances or parts of ordinances in conflict herewith
are repealed to the extent of such conflict.
SECTION 4: Should any section or provision of this ordinance or any
portion hereof or any paragraph, sentence or word be declared by a Court of
competent jurisdiction to be invalid, such decision shall not affect the validity
of the remainder hereof as a whole or any part hereof other than the part
declared to be invalid.
SECTION 5: This ordinance shall become effective upon its final
passage.
