O -d0 �3�Z AN ORDINANCE CREATING SECTION 7-10 OF THE CITY CODE TO PERMIT A DEVELOPER OF A SINGLE FAMILY FEE SIMPLE RESIDENTIAL SUBDIVISION PARCEL OF PROPERTY TO SUBMIT A FINAL SITE PLAN TO THE PLANNING COMMISSION IN LIEU OF PRELIMINARY AND FINAL SITE PLANS, AND PERMITTING CONSID- ERATION BY THE PLANNING COMMISSION OF THE FINAL SITE PLAN AT ONE MEETING ONLY; CREATING SECTION 20-19.1 OF THE CITY CODE PERMITTING AN OWNER OF PROPERTY TO SUBMIT A FINAL PLAT TO THE PLANNING COMMISSION IN LIEU OF A PRELIMINARY AND FINAL PLAT FOR SINGLE FAMILY FEE SIMPLE RESIDENTIAL SUBDIVISION PLATS ON INDIVIDUALLY PLATTED LOTS, AND PERMITTING CONSIDERATION BY THE PLANNING COMMISSION AT ONLY ONE MEETING; PROVIDING FOR CODIFICATION; PROVIDING FOR NONSEVERABILITY OF INVALID PROVISIONS; PROVIDING REPEALER; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council wants to expedite the Plat and Site Review Process, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: Section 7-10 of the Tamarac City Code is hereby created and shall read as follows: Section 7-10. Optional Procedure for Single Family Fee Simple Residential Subdivision Site Plans with Individual Lots. As an alternative to the procedures established in this Chapter, the applicant for site plan review may, in the case of single family residential subdivision site plans where there are individual fee simple lots, submit a final site plan for review by staff and consideration by the Planning Commission without previously submitting a preliminary site plan. This final site plan shall contain all information required within Sections 7-6 and 7-7 of the Tamarac City Code, as may be amended from time to time. The developer may agree that a proposed site plan can be tabled by the Planning Commission for a specific period of time. If the developer does not so agree, the Planning Commission shall take action either affirmatively or negatively when the site plan is before it. Nothing in this optional procedure shall modify or alter in any way, shape or form the authority of the City Council in considering the site plan when it comes before that body, and there is no modification meant or intended to any documents which need be submitted to the City, or any findings which need be made by the City prior to approval. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 SECTION 2: Section 20-19.1 of the Tamarac City Code is hereby created and shall read as follows: Section 20-19.1. Optional Plat Review Procedure for Single Family Fee Simple Residential Subdivision Plats with Individually Platted Lots. As an optional procedure at the choice of the property owner, he may submit or cause to be submitted, a final plat for review by staff and for consideration by the Planning Commission without previously submitting preliminary plat. The final plat submitted shall contain all information required to be in both the preliminary plat and the final plat as set forth in Sections 20-15 and 20-19 of the Tamarac City Code, as may be amended from time to time. The Planning Commission shall be obligated to either recommend approval or rejection of the plat when said plat is submitted to it, unless the owner agrees that the Planning Commission may table the matter for a specific period of time. Nothing in this optional procedure shall modify or alter in any way, shape or form the authority of the City Council in considering a Plat when it comes before that body, and there is no modification meant or intended to any documents which need to be submitted to the City, or any findings which need to be made by the City prior to approval. This Section only applies to single family fee simple subdivision plats with individually platted lots, and it does not include single family homes or townhouses or any other type of development where all of the ground level other than the buildings are owned by the entire community such as condominiums or homeowners association. SECTION 3: Specific authority is hereby granted to codify this ordinance SECTION 4: All ordinances or parts of ordinances in conflict herewith are repealed to the extent of such conflict. SECTION 5: In the event that any word, paragraph or section of this ordinance is declared to be invalid by a court of competent jurisdiction the entire ordinance is null and void and the entire optional procedures established herein are null and void thereby necessitating preliminary site plan and preliminary plat approval of all projects. -2- 1 2 3 4 5 6 7 8 9 10 11 1 12 1 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 35 36 SECTION 6: This ordinance shall become effective immediately upon its final passage.
