AN ORDINANCE AMENDING SECTION 2-3 OF THE TAMARAC CITY
CODE BY CREATING SUBSECTION (e) TO PERMIT ADMINISTRATIVE
REFUNDS OF FEES OR MONIES COLLECTED ERRONEOUSLY OR FOR
REFUNDS DUE FOR OTHER REASONS BY DELEGATING CERTAIN AUTHORITY
TO MAKE REFUNDS TO THE CITY MANAGER; PROVIDING FOR APPEAL TO
THE CITY COUNCIL; PROVIDING FOR CODIFICATION; PROVIDING RE-
PEALER; PROVIDING -FOR SEVERABILITY OF INVALID PROVISION; PRO-
VIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY,THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: Section 2-3 of the Tamarac City Code is amended by
adding subparagraph (e) which shall read as follows:
(e) Minor Refunds. Notwithstanding any other provisions
in this section the City Manager is hereby authorized to administratively
approve refunds for monies erroneously collected or which otherwise are
due provided that this authority shall not exceed a refund in the
amount of $ 50.00. If the City Manager denies a request for a refund"
for adjustment then the individual denied may appeal to the City
Council following the refund procedures set forth under subparagraphs
(a), (b), and (c) of this section.
SECTION 2: Specific authority is hereby granted to codify this ordinance.
SECTION 3: All ordinances or parts of ordinances in conflict herewith
are repealed to the extent of such conflict.
SECTION 4: Should any section or provision of this ordinance or any
portion hereof or any paragraph, sentence or word be declared by a Court of
competent jurisdiction to be invalid, such decision shall not affect the validity
of the remainder hereof as a whole or any part hereof other than the part declared
to be invalid.
SECTION 5: This ordinance shall become effective immediately upon
its final passage. _
