AN ORDINANCE AMENDING SECTION 7-8.4 OF THE TAMARAC CITY
CODE BY PROVIDING THAT SITE DEVELOPMENT PLAN SUBMISSION
FEES ARE TO BE SET BY RESOLUTION OF THE CITY COUNCIL;
PROVIDING FOR CODIFICATION; PROVIDING REPEALER; PROVIDING
FOR SEVERABILITY AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, it is the policy of the City Council that whenever possible
fees be established by Resolution, and
WHEREAS, site development plan submission fees under the authority
of prior ordinances are established by Resolution, and
WHEREAS, Section 7-8.4 of the City Code still has language stating
amounts for these fees, and
WHEREAS, the City Council wishes to remove this language from the
City Code.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That Section 7-8.4 of the City Code shall read as follows
Sec. 7-8.4. Site development plans submission fees.
Each preliminary site development plan shall be accompanied by an
initial administrative review fee, in accordance with a schedule established
by resolution of the City Council.
SECTION 2: Specific authority is hereby granted to codify this
ordinance.
SECTION 3: All ordinances or parts of ordinances in conflict
herewith are repealed to the extent of such conflict.'
SECTION 4: Should any section or provision of this ordinance or
any portion hereof or any paragraph, sentence or word be declared by a court of
competent jurisdiction to be invalid, such decision shall not affect the validity
of the remainder hereof as a whole or any part hereof other than the part
declared to be invalid.
