O — AN ORDINANCE AMENDING THE DEFINITION OF NONCONFORMING USE IN SECTION 28-1 OF THE TAMARAC CITY CODE BY RE- MOVING FROM THE DEFINITION STRUCTURES IN EXISTENCE WHEN SETBACK REQUIREMENTS ARE CHANGED: PROVIDING FOR CODIFICATION; PROVIDING REPEALER; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: Section 28-1 of the Tamarac City Code is amended by adding the words, numbers and punctuation underscored and by removing the words, numbers and punctuation struck through as follows: Sec. 28-1. Definitions. For the purposes of this chapter, the following words and phrases shall have the meanings respectively ascribed to them by this section: Accessory building: A subordinate building which is located on the same lot as the main building, the use of which building is clearly incidental to the use of the main building. Accessory uses: Uses customarily incident to the permitted principal uses. Apartment: "Apartment" or "apartment house" is a building occupied or intended to be occupied by more than two (2) families, living separately and with separate kitchens or facilities for doing their own cooking on the premises, or by more than two (2) families, individuals or groups of individuals. Building: Any enclosure having a permanent location on the land, excepting walls, fences and hedges not exceeding five (5) feet in height. Duplex: A building divided horizontally or vertically and designed for or occupied by two (2) single-family housekeeping units, having one roof and one dividing partition common to each unit; furthermore, at least one habitable room or garage in each unit shall adjoin for a distance not less than ten (10) feet in length. Private outdoor areas shall be provided for each unit visually screened from the adjoining dwelling unit. Dwelling, multiple -family: An apartment as defined herein. Dwelling, one -family: A detached building designed for or occupied exclusively by one family. Family: One or more persons living together as a single housekeeping unit, supplied with a kitchen or facilities for cooking on the premises. Height, building: The vertical dimension measured from the average elevation of the finished lot grade at the front of the building to the top of a parapet, or to the top of a flat roof, or to the mid -height of an angular roof, whichever is the tallest. Elevator housing and stairwells may extend up to ten (10) feet above the height of a building. Lot: A parcel or tract of land, fronting on a street which is -or may be occupied by a building, and including open spaces required under this chapter, which parcel or tract of land is described by a plat recorded among the public records of the county. Lot, corner: A lot abutting on two (2) or more intersecting streets. Lot depth: The distance measured from the midpoint of the street lot line to the midpoint of the opposite rear lot line. In the case of a corner lot, the depth shall be the longer of the two (2) possibilities. Lot line: The lines bounding a lot. Lot width: The average distance between side lot lines, measured at right angles to the line used to determine the depth of the lot. 14 � 1 2 3 4 5 6 7 81 91 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 0 31 32 33 34 35 36 Mixed occupancy: Occupancy of a building for more than one use. Non conforming use: Use or occupancy of a building or land not conforming to the requirements of this chapter. When setbacks have been modified for zoning districts, structures erected prior to the effective date of the revised regulations which met the setback requlations when erected, shall not be considered nonconformin uses. Parking space: A parcel of land having an area of not less than two hundred (200) square feet and suitable for the parking of one automobile, together with necessary and adequate land for the approach, turning and exit of an automobile. Porch: A roofed space attached to the exterior wall of a building, open on one or more sides. Setback: The minimum horizontal distance between a building and the boundary lines of the lot on which the building is located, measured at right angles to the boundary line. Street: A public way affording principal means of access to abutting property. Structure: Anything constructed or erected, the use of which requires permanent location on the land, except hedges, shrubs and trees. Yard: An open space or area on the same lot as a building, unoccupied and unobstructed from the ground upward by any building. Yard, front: The yard between the front property line and the front line of any building, measured at its least dimension and extending from one side lot line to the other, exclusive of steps, platforms, open terraces and walls not exceeding five (5) feet in height. Yard, rear: The yard extending across the full width of the lot between the rear line of any building and the rear lot line, measured at its least dimension, exclusive of steps, platforms, open terraces and walls not exceeding five (5) feet in height. Yard, side: The yard extending between a building and the side lot line, extending from the front yard to the rear yard, measured at its least dimension, exclusive of steps, platforms, open terraces and walls not exceeding five (5) feet in height. (Ord. No. Ordinance. SECTION 2: Specific authority is hereby granted to codify this SECTION 3: All ordinances or parts of ordinances in conflict herewith are repealed to the extent of such conflict. SECTION 4: Should any section or provision of this ordinance or any portion hereof or any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof other than the part declared to be invalid.
