CITY OF TAMARAC, FLORIDA
ORDINANCE NO. 0--70-- 41
AN ORDINANCE EXEMPTING FROM APPLICATION IN THE CITY OF TAMARAC,
BROWARD COUNTY ORDINANCE NO. 80-1 RELATING TO BINGO AND THE
LICENSING AND REGULATION OF BINGO IN BROWARD COUNTY; AND
AMENDING SECTION 28-197.1 OF THE CITY CODE PERTAINING TO BINGO
GAMES BY PERMITTING SAID GAMES IN DISTRICTS OTHER THAN S-1
UNDER CERTAIN LIMITED CIRCUMSTANCES; PROVIDING FOR CODIFICATION;
PROVIDING REPEALER; PROVIDING FOR NONSEVERABILITY OF INVALID
PROVISIONS SO THAT IF ANY WORD, SENTENCE, PARAGRAPH OR PROVISION
OF THIS ORDINANCE IS DECLARED INVALID BY A COURT OF COMPETENT
JURISDICTION THEN THE ENTIRE ORDINANCE SHALL BE NULL AND VOID;
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: FINDING OF FACT
The Broward County Commission adopted Ordinance No. 80-1 relating to
the regulation and licensing of Bingo within Broward County on January 16, 1980.
This County ordinance may be applicable in municipalities under the Broward
County Charter only in the event that there is no conflicting municipal regulation,
The City of Tamarac does not determine Broward County Ordinance No. 80-1 to be in
the best interests of the City and wishes to specifically exempt therefrom bingo
games in Tamarac which comply with Tamarac regulations.
SECTION
2: Broward
County Ordinance No.
80-1
is hereby declared in-
applicable to Bingo
games within
the City of Tamarac
which
comply with all
applicable City regulations. Any operator or potential operator of Bingo games
in the City must only comply with all applicable provisionsof State law and with
all applicable provisions of the Tamarac City Code.
SECTION 3: Section 28-197.1 of the City Code is amended by adding
the words, punctuation and numbers underscored and deleting the words, punctuation
and numbers struck through as follows:
Section 28-197.1. Bingo games.
In any S-1 zoned district and in houses of worship only,exce�t
as otherwise set forth herein, bingo games shall be permitted;

strictions; that (1) no person conducting or assisting in the operatic
compensation

the requirements in Section 849.083, F.S., as amended from time to
time. and in Section 14, Article X, of the City Code, as amended from

time to time, shall be complied with, (3) the sponsor may
not contract withanyfirm,cor2oration, or individual
to operate or manage the games for it.
Bingo games shall be permitted in B-1 and B-2 zoning
districts, subject to the same restrictions as if the game
was conducted in an S-1 zoning district or a house of
worship, if the non-profit organization which applies for
the permit has been housed in and operating in the City of
Tamarac for not less than three (3) years.
SECTION 4: Specific authority is hereby granted to codify
this ordinance.
SECTION 5: All ordinances or parts of ordinances in
conflict herewith are repealed to the extent of such conflict.
SECTION 6: In the event any word, paragraph, phrase,
sentence of this ordinance shall be declared to be invalid by a Court
of competent jurisdiction, the entire ordinance shall be rendered null
and void and the provision of Broward County Ordinance No. 80-1 shall
apply in the City and the regulations in effect prior to the date of
this ordinance shall become applicable.
SECTION 7: This ordinance shall become effective upon its
final passage.
