S AN ORDINANCE AMENDING SECTIONS 6-9, 6-12(c)(4), 6-12(d), 6-13(b)(4), 6-15(d), 6-17 AND 7-7(b) OF THE TAMARAC CITY CODE PERTAINING TO THE BEAUTIFICATION COMMITTEE AND LAND- SCAPING PLANS BY PROVIDING THAT THE FUNCTION FOR REVIEW OF LANDSCAPE PLANS SHALL BE TRANSFERRED FROM THE PLANNING COMMISSION TO THE BEAUTIFICATION COMMITTEE; AMENDING SECTION 6-2 OF THE CITY CODE BY REDUCING MEMBERSHIP ON THE BEAUTIFICATION COMMITTEE FROM SEVEN MEMBERS TO FIVE MEMBERS; AND REPEALING SECTION 6-18 OF THE CITY CODE WHICH ESTABLISHED RIGHTS FOR CERTAIN APPLICATIONS PENDING AT THE TIME THE BEAUTIFICATION ORDINANCE WAS ENACTED; MODIFYING SECTION 6-4 BY DELETING REFERENCE TO ZONING COMMISSION AND SUBSTITUTING PLANNING COMMISSION; PROVIDING FOR CODIFICATION; PROVIDING REPEALER; PROVIDING SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: FINDINGS OF FACT The City Council determines that it would be more appropriate for Landscape Plans to be reviewed by the City's Beautification Committee rather than by the City's Planning Commission and accordingly, finds and determines that said transfer is in the best interest of the public, health, safety and welfare. This public interest would best be served by reducing the number of members on the Beautification Committee from seven to five. SECTION 2: Section 6-9 of the City Code is amended by adding the words, numerals and punctuation underscored, and deleting the words, numerals and punctuation struck through as follows: Sec. 6-9. Duties generally. The duties of the beautification committee shall be to advise and recommend to council amd-the-Fem 4 g-eefmissiee action to be taken in the following matters as they concern beautification and conservation factors: (a) The overall appearance of the city. (b) Long range plans for beautification projects. (c) Review of site plan landscaping. (d) Conservation programs. (e ) Sign review as set forth in Chapter 21_ of City Code as ­- A -A -r-^m +i mn +n +i mo SECTION 3: Section 6-12(c)(4) of the City Code is amended by adding the words, numerals and punctuation underscored, and deleting the words, numerals and punctuation struck through as follows: 1 2 3 4 1 5 6 7 8 9 10 11 12 13 14 15 16 17 t8 9 20 III 21 22 23 24 25 26 27 28 29 '0 a1 32 33 34 35 36 Section 6-12(c)(4). The plans}ng-eeFAF4sa4en beautification committee and/or the city council may require that additional landscaping be provided to screen structures because of their location in relation to adjacent properties. SECTION 4: Section 6-12(d) of the City Code is amended by adding the words, numerals and punctuation underscored, and deleting the words, numerals and punctuation struck through as follows: Section 6-12(d). Applicable Requirement Where Use Is by Special Exception. The beautification committee and/or the city council may require that additional landscaping be provided to screen or buffer structures in commercially zoned districts listed in this section, where the permitted use is only by special exception. SECTION 5: Section 6-13(b)(4) of the City Code is amended by adding the words, numerals and punctuation underscored, and deleting the words, numerals and punctuation struck through as follows: Section 6-13(b)(4). SECTION 7: Section 6-17 of the City Code is amended by adding the words, numerals and punctuation underscored, and deleting the words, numerals and punctuation struck through as follows: Section 6-17. Plan approval. Prior to the issuance of any building permit, as required by Chapter 7 of the Tamarac Code, a landscape plan conforming to the requirements specified herein shall be submitted with-the-Anal-site-develepFReRt-plan for review by the planning commission to the beautification committee and fen-app-renal-by to the ci council for ap_p__roval_. SECTION 8: Section 7-7(b) of the City Code is amended by adding the words, numerals and punctuation underscored, and deleting the words, numerals and 2. punctuation struck through as follows: 1 (b) Landscape plans. Landscape plans shall be submitted 2 on a separate drawing-w-*th-the-f4Ra;-s4te-deve;epfeet-p4ae-der 3 review-by-the-plaAA*ng-eemmm ss4ep to the beautification 4 committee accompanied with a city landscape checklist completed 5 by the petitioner. The following information is required to be 6 included on all landscape plans (in scale) no less than one inch 7 equals thirty (30) feet, on twenty -four -inch by thirty -six-inch 8 sheets. 9 (1) Ten (10) copies of landscape plans sealed either by a 10 registered architect or landscape architect or nurseryman 11 approved by the chief building official. 12 (2) Project title. 13 (3) Developer. 14 (4) North arrow and scale. 15 (5) All boundary dimensions. 16 (6) All existing vegetation. 17 (7) Preserved trees and relocated trees. 18 (8) Certification that an irrigation system (free of rust) will 19 be provided for the landscaped area. 20 (9) Common names as well as botanical names of proposed plant 21 material with minimum trunk diameter and height at time of 22 planting. Include type of ground cover. 23 (10) Location and size of material to be used. 24 (11) Design, location and material of any walls and fences. 25 Include car stops and curbing. 26 (12) Location or proposed ground signs, if any. 27 (13) Location of dumpsters, if any. 28 (14) Elevations of structures showing concealment of roofscapes. 29 All developments shall incorporate native vegetation into 30 landscape plans. Undesirable species, such as Australian pine 31 (Cesurina), Brazilian pepper (Florida holly), Castor bean, and 32 Melaleuca, shall be prohibited. Where a commercially zoned 33 district abuts a residential district, refer to the ordinances 34 on setbacks, fences, trash containers or dumpsters for 35 additional requirements. 36 3. 22 23 24 25 26 27 28 29 32 33 34 35 36 The beautification committee shall approve the landscape plans prior_to final site,plan approval * the planning commission. SECTION 9: Section'6-2 of the City Code is amended by adding the words, numerals and punctuation] underscored, and deleting the words, numerals and punctuation struckthrough as follows: Section 6-2. SECTION 10: Section 6--4 of the City Code is amended by adding the words, numerals and punctuation underscored, and deleting the words, numerals and punctuation struck through as follows: Section 6-4. Ex officio members. The following are designated as ex officio members of the beautification committee, who shall be nonactive members without voting powers: (a) Member of the zen4ng planning commission, to be designated by such commission. (b) Member of the city council, to be designated by council. (c) Chief building official, or his designate. SECTION 11: Section 6-18 of the City Code is hereby repealed. SECTION 12: Specific authority is hereby granted to codify this ordinance. SECTION 13: All ordinances or parts of ordinances in conflict herewith are repealed to the extent of such conflict. SECTION 14: Should any section or provision of this ordinance or any portion hereof or any paragraph, sentence or word be declared by a court of - competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof other than the part declared to be invalid.
