CITY OF TAMARAC, FLORIDA
ORDINANCE NO.
AN ORDINANCE AMENDING SECTION 2-4 OF THE TAMARAC
CITY CODE PERTAINING TO ELECTED OFFICIALS TERMS
OF OFFICE BY MODIFYING THE DATE WHICH ELECTED
OFFICIALS OF THE CITY TERMS OF OFFICE BEGIN;SETTING
FORTH FINDINGS OF 'FACT; PROVIDING FOR CODIFICATION;
PROVIDING REPEALER; PROVIDING FOR SEVERABILITY OF
INVALID PROVISION AND PROVIDING AN EFFECTIVE DATE.
. WHEREAS, Chapter 75-350 Laws of Florida as amended provides
that the specific day when duly elected municipal officers shall
take office shall not exceed fourteen days from the date of election
and shall be decided by local ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: FINDING OF FACT.
Present regulations provide that the terms of office of
elected officials begin on noon of the date following the election or
upon receipt of certification from Broward County. This can create
significant problems especially when there are contested elections as
the candidates who are not incumbents would not have an opportunity
to consult with staff and review backup material for meetings which
might take place on the day after the election. It is not fair to a
candidate to require him to be sworn in and then to vote on matters
for which he has not had an opportunity to fully prepare and,
accordingly, it is determined to be in the best interests of the healtr
safety and welfare of the people in the City of Tamarac to modify the
date in which an official may be sworn into office.
SECTION 2: 8ecti.on2-4 of the Tamarac City Code is hereby
amended by adding the words, numbers and punctuation underscored and
deleting the words, numbers and punctuation struck through as follows:
Sec. 2-4. Elected officials; terms of office.
The terms of office for those duly elected municipal officers

The officials shall be sworn in at a special meetin of the
City Council of the City of Tamarac.
SECTION 3: Specific authority is hereby granted to codify
this ordinance.
SECTION 4: All ordinances or parts of ordinances in conflict
herewith are hereby repealed to the extent of such conflict.
SECTION 5: Should any section or provision of this ordinance
oK any portion hereof or any paragraph, sentence or word be declared
by a Court of competent jurisdiction to be invalid, such decision
shall not affect the validity of the remainder hereof as a whole
or any part hereof other than the part declared to be invalid.
SECTION 6: This ordinance shall become effective upon its
final passage.
