CITY OF TAMARAC, FLORIDA
ORDINANCE NO. Q -
AN ORDINANCE VACATING ROAD RIGHT-OF-WAY LOCATED AT
THE FORMER PROPOSED ENTRANCE ROAD TO WOODMONT TRACT 47
LOCATED FROM THE NORTH SIDE OF N.W. 81st STREET EAST
OF N.W. 88th AVENUE IN THE CITY OF TAMARAC; PROVIDING
FOR REPEALER; PROVIDING FOR SEVERABILITY; AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, the property described in Exhibit"A"and shown on the
Map contained in Exhibit "A", attached hereto and made a part hereof, were
dedicated by Simon Zunamon, as Trustee, under the provisions of a certain trust
agreement dated December 1, 1972 and known as Trust No. 101 to the City of
Tamarac in January 1977; and
WHEREAS, the right-of-way dedication was at the site of the
proposed road entranceway of Woodmont Tract 47, and
WHEREAS, this dedication agreement was recorded in the Official
Records of Broward County in Official Records Book 6890, at Pages59, 60, 61, 62
and 63; and
WHEREAS, the grantor of the property no longer owns same,and
WHEREAS, the grantor no longer owns the property adjoining the
right-of-way that was dedicated; and
WHEREAS, the current owners of the property adjacent to the
right-of-way dedicated have requested that the City of Tamarac vacate the
right-of-way;and
WHEREAS, the right-of-way is located in the Woodmont Golf Course;
and
WHEREAS, the right-of-way will not be used for road purposes,
and another right-of-way must be dedicated to the City of Tamarac prior
to the time of development of Woodmont Tract 47; and
WHEREAS, maintenance of ownership in the name of the City of
Tamarac will not be of any appreciable benefit to the public health, safety
and welfare of the citizens of Tamarac.
OF TAMARAC:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
SECTION 1: FINDING OF FACT
That the recitations contained in the Whereas clauses set forth
above are found to be true and accurate and are adopted as part of the findings

of fact.
SECTION 2: That the property described in Exhibit "A", which
property was dedicated to the City of Tamarac by separate instrument,as opposed
to dedication on a plat, is'hereby vacated, with title to be vested in the
property owners on each side of the dedicated property to the extent that each
property owner shall be entitled to ownership of one-half of that property
_adjacent to their property.
SECTION 3: All ordinances or parts of ordinances or parts of
ordinances in conflict herewith are repealed to the extent of such conflict.
SECTION 4: Should any section or provision of this ordinance
or any portion hereof or any paragraph, sentence or word be declared by a
court of competent jurisdiction to be invalid, such decision shall not affect
the validity of the remainder hereof as a whole or any part hereof other
than the part declared to be invalid.
SECTION 5: This ordinance shall become effective upon its final
passage.
