AN ORDINANCE AMENDING SECTION 28-49 OF THE TAMARAC
CITY CODE BY REDUCING THE REAR YARD SETBACK
REQUIREMENT IN R--2 ZONING DISTRICTS; PROVIDING FOR
CODIFICATION; PROVIDING REPEALER; PROVIDING FOR
9EVERABILITY OF INVALID PROVISIONS; AND PROVIDING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC,
FLORIDA:
SECTION 1: Section 28-49 of the Tamarac City Code is
amended by adding the words, numerals and punctuation underscored
and by deleting the words, numerals and punctuation struck through
as follows:
Sec. 28-49 Rear Yards
(a) Residential uses. Every plot whose principal use is,
residential shall have a rear yard not less than +_-wentY-five-i25}
fifteen (15) feet in depth. Every lot used for two story dwelling
purposes shall have a rear yard not less than twenty (20) feet in
depth. In cases where a rear lot line abuts a waterway without
a bulkhead, the rear yard shall not be less than twenty-one (21)
feet in depth.
(b) Ncmresidential uses. Every plot whose principal use
is nonresidential shall have a rear yard not less than twenty-five
(25) feet in depth.
SECTION 2: Specific authority is hereby granted to codify
this ordinance.
SECTION 3: All ordinances or parts of ordinances in
conflict herewith are repealed to the extent of such conflict.
SECTION 4: Should any section or provision of this
ordinance or any paragraph, sentence or word be declared by a
court of competent jurisdiction to be invalid, such decision shall
not affect the validity of the remainder hereof as a whole or any
part hereof other than the part declared to be invalid.
