CITY OF TAMARAC, FLORIDA
ORDINANCE NO. Q , 0-66
AN EMERGENCY ORDINANCE ELIMINATING CERTAIN PARKING REQUIREMENTS
FOR A PROPOSED BUILDING ADDITION BY THE TAMARAC JEWISH CENTER;
SETTING FORTH BASIS FOR EMERGENCY; PROVIDING REPEALER; PROVIDING
FOR SEVERABILITY OF INVALID PROVISIONS; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: FINDING OF FACT AND DECLARATION OF EMERGENCY
The Tamarac Jewish Center has submitted to the City Council a site
plan for an addition to the Jewish Center, which addition would be used for
educational facilities. The Jewish Center has represented that it expects
approximately 400 students to be using the addition for their educational purposes
`for the school year commencing in the fall of 1980. Any delay in approving the
site plan and allowing construction to begin will cause a delay in the completion
of the educational facility to the detriment of the students. Accordingly, an
emergency situation exists which necessitates the enactment of an emergency
ordinance which would allow approval of the site plan with 37 parking spaces
which had been shown within the setback area removed for computation of parking
needs and reducing the parking needs by those 37 spaces. It is, however, under-
stood by the City that the Jewish Center is in the process of acquiring additional
property which the City understands will be paved used for parking purposes for
the educational facility and for the existing religious facility as expeditiously
as possible.
SECTION 2: That notwithstanding any other provision contained
within Chapter 18 of the Tamarac City Code pertaining to off street parking
requirements, and contained within Chapter 28 of the City Code pertaining to
zoning regulations, the Tamarac Jewish Center shall be permitted to eliminate from
its site plan 37 parking spaces originally shown as being within the setback area
and that despite the elimination of 37 required parking spaces, the site plan may
be approved by the City Council.
SECTION 3: Should any section or provision of this ordinance
or any portion hereof or any paragraph, sentence or word be declared by a Court
of competent jurisdiction to be invalid, such decision shall not affect the
validity of the remainder hereof as a whole or any part hereof other than the part
declared to be invalid.
