CITY OF TAMARAC, FLORIDA
ORDINANCE NO. O—$o - %/_
AN ORDINANCE AUTHORIZING THE CITY OF TAMARAC, FLORIDA, TO
PROVIDE FOR THE EXPENDITURE OF PUBLIC FUNDS FOR PAYMENTS TO
EMPLOYEES "ON ACCOUNT OF SICKNESS" IN ACCORDANCE WITH CHAPTER
22C-2 OF THE RULES OF THE DEPARTMENT OF ADMINISTRATION OF THE
STATE OF FLORIDA
WHEREAS, Chapter 22C-2 of the Rules of the Department of Administration
of the State of Florida requires that a reporting unit must have constitutional
or statutory authority to expend public funds "on account of sickness", and
WHEREAS, it is a prerequisite that the City of Tamarac enact an
ordinance that specifically allows it to make payments to employees "on account
of sickness" in order to be able to exclude social security deductions from said
payments.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That the City of Tamarac, Florida, shall be and it is
hereby authorized to provide for the expenditure of public funds for payment
to employees "on account of sickness" which are defined as payments to an employee
for the personal sickness or illness of the employee. Not included within the
definition are payments to an employee for time the employee was away from work
due to illness in his/her immediate family or legal quarantine which may be the
subject of leave for other purposes and which may be provided for in Rules and
Regulations or in Collective Bargaining Agreements.
SECTION 2: That the City Council of the City of Tamarac, Florida, by
this ordinance provides statutory authority for the City of Tamarac Finance Director
to make payments to employees "on account of sickness" to satisfy Chapter 22C-2
of the Rules,of the Department of Administration of the State of Florida and in
accordance with the City of Tamarac Personnel Rules and Regulations; pursuant to
this ordinance, these payments are excluded from employees' wages subject to the
Social Security Act.
SECTION 3: All ordinances or parts of ordinances in conflict herewith
are repealed to the extent of such conflict.
SECTION 4: Should any section or provision of this ordinance or any
portion hereof or any paragraph, sentence or word be declared by a Court of
competent jurisdiction to be invalid, such decision shall not affect the validity
of the remainder hereof as a whole or any part hereof other than the part declared
I to be invalid.

SECTION 5: This ordinance shall become effective upon its final
passage.
