HomeMy WebLinkAboutCity of Tamarac Ordinance O-1980-073Sponsored by: Temp. #717 Revised 6/11/80 CITY OF TAMARAC, FLORIDA 1 ORDINANCE# O -,?0 - %3 2 AN ORDINANCE PROVIDING THAT ALL GASOLINE STATIONS DOING BUSINESS IN THE CITY SHALL 3 POST SIGNS ADVERTISING THE PRICES CHARGED FOR GASOLINE ON A DAY-TO-DAY BASIS; REPEALING 4 ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR INCLUSION 5 IN CODE; PROVIDING AN EFFECTIVE DATE. 6 7 WHEREAS, the international oil crises results in the 8 fluxuation of gasoline prices, from day-to-day and from week -to -week, and 9 WHEREAS, there are a number of gasoline stations in the 10 City of Tamarac which change the price of gasoline from time to time, and 11 WHEREAS, the City Council has determined, upon investigation 12 and inquiry, that there may exist, during any period of time, great variance 13 between the prices of gasoline charged from gas station to gas station within 14 the City, and 15 WHEREAS, the gasoline stations within the City of Tamarac 16 are located on major thoroughfares already bearing traffic loads beyond the 17 capacity of the applicable road design, and 18 WHEREAS, the fact that various gasoline stations do not 19 publish or post signs of prevailing gasoline prices creates additional ingress/ 20 egress trips -on and off the thoroughfares, as a result of the fact that people will 21 not buy or are unable to buy gasoline at these high prices and, thus, leave one 22 gasoline station to find less .expensive gasoline at another gasoline station, and 23 WHEREAS, the City Council has determined that the additional 24 ingress/egress trips create a greater potential for traffic hazard, and 25 WHEREAS, the City Council has also determined that the posting 26 of gasoline prices, readily visible to the driving public, would decrease the 27 number of ingress/egress trips off of and on to the major thoroughfares and would, 28 therefore, diminish the potential for traffic accidents, 29 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE 30 'CITY OF TAMARAC, FLORIDA, AS FOLLOWS: SECTION: 1 31 Gasoline Price Signs. (1) All gasoline stations doing business in the City shall post a sign on the premises of the gasoline station: 32 in a location so that such sign is clearly visible to the driving public, on which shall be conspicuously displayed the prices being 33 charged for gasoline on each day, from day-to-day. Such sign shall be of a size not less than six (6) square feet in area and 34 not more than sixteen (16) square feet in area, with numbers and letters showing the type of gasoline not less than five 35 (5) inches in height. Each gasoline station shall depict on such sign the price of each type of gasoline being offered, from day-to- 36 day, at such station. 1 2 3 4 5 5 8 9 10 11 12 13 14 15 16 17 a 8 20 21 22 23 24 25 26 27 28 29 30 0 33 34 35 36 All stations shall be in compliance with the mandates hereof within ten (10) days from the effective date of the Ordinance creating this Section. (2) At least two (2) grades of gasoline, diesel fuel or other product sold to power motorized vehicles (one of which shall be unleaded gasoline) shall have their unit price displayed in Arabic numerals no smaller than ten (10) inches high on a sign as provided in (1) above. (a) If a unit price is in increments of less than one (1) gallon or a unit price is measured in other than gallons, said unit measure shall be clearly displayed in numerals no less than eight (8) inches high on the sign as provided for above. (b) Should gasoline, diesel fuel or other product sold to power motorized vehicles be sold by any unit measure other than by gallons or fraction thereof, a table or chart shall be provided within view of each pump showing the equivalent of each unit to a gallon. - (c) If at any time a price for a particular grade of gasoline is displayed or that the price of gasoline is for "self serve" or "full serve", said gasoline product or such service must be available. (3) Any person who owns or manages a gasoline or diesel station, service station or other retail gasoline or diesel outlet and who shall violate any of the provisions of this Ordinance shall, upon conviction before a court of competent jurisdiction, be subject to a fine of fifty (50) dollars. Each day of non-compliance shall be a separate violation. (4) No sign permit required for signs required under this Ordinance. SECTION 2: Conflict: All Ordinances or Code provisions in conflict herewith are hereby repealed. SECTION 3: Severability: If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any Court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions of this Ordinance. SECTION 4: Inclusion in Code: It is the intention of the City Council of the City of Tamarac that the provisions of this Ordinance shall become and be made a part of the Code of ordinances of the City of Tamarac and that the sections of this Ordinance may be renumbered or relettered and the word "Ordinance" may be changed to "Section", "Article" or such other appropriate word or phrase, the use of which shall accomplish the intentions herein expressed. SECTION 5: Effective Date: This Ordinance shall become effective immediately upon its final passage. PASSED ON FIRST READING THE // DAY OF ,1980.
