AN ORDINANCE PLACING ON THE BALLOT OF NOVEMBER 4, 1980, PROPOSED AMENDMENTS TO THE CHARTER OF THE CITY OF TAMARAC, AMENDING THE FOLLOWING SECTIONS OF THE TAMARAC CITY CODE: SECTION 4.04 - BY CHANGING THE PROVISION PERTAIN- ING TO COMPENSATION AND EXPENSES OF MAYOR AND COUNCIL, AND SECTION 8.01 REQUIRING CANDIDATES FOR AND MEMBERS OF THE CHARTER BOARD WHEN ELECTED TO BE ELECTOR RESIDENTS OF THE CITY; PROVIDING THAT EACH QUESTION IS TO BE CONSIDERED SEPARATELY; PROVIDING THAT EACH QUESTION APPROVED BY A MAJORITY OF THE VOTERS AT THE NOVEMBER 4, 1980 ELECTION SHALL BECOME AN AMENDMENT TO THE CHARTER OF THE CITY OF TAMARAC UPON CERTIFICATION AND ACCEPTANCE OF THE ELECTION RESULTS; PROVIDING FOR SEVERABILITY OF INVALID PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City's Charter Board and Council have suggested amendments to various provisions in the City Charter;and WHEREAS, hearings have been conducted concerning Charter amendments by both the City Council and by the Charter Board. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION l: That the following questions are to be presented separately to the electorate of the City of Tamarac at its November 4, 1980, election and any of the following questions which are approved by a majority of the electorate at said election shall become an amendment to the City Charter: Question 1. Shall Section 4.04 of the Tamarac City Charter be amended to provide that the salary of the Mayor shall be $400 per month and the salary of ,the individual council, members shall be $300 per month, effective upon passage of this question? If this question is approved, the words that are struck through will indicate the deletions and the underscored words will indicate the additions to in Section 4.04. Section 4.04 -- Compensation and Expenses of mayor and Council The salary of the Mayor shall be $159.99 $400 per month and the salary of the individual Council members shall be $+99:99 $300 per month. 1 2 3 4 5 8 9 10 11 12 13 14 15 16 17 8 20 21 22 23 24 K-V 1 26 27 28 29 z0 I'll 32 33 34 35 36 The Mayor shall be entitled to receive his actual and necessary expenses allowable by law, not to exceed three thousand ($3,000.00) dollars per year incurred in the Performance of his duties as Mayor upon delivery of an itemized voucher to the City Manager. Each Council member (other than Mayor) shallbe entitled to receive his actual and necessary expenses allowable by law, not to exceed two thousand ($2,000.00) dollars per year incurred in the performance of his duties as council member upon delivery of an itemized voucher to the City Manager. Expense limitations for the Mayor and Council shall be calculated per elected year. Question 2. Shall Section 8.01 of the Tamarac City Charter be amended to require candidates for, and members of the Charter Board when elected to be elector residents of the City.? If Question 2 is approved, the words struck through would indicate the deletions and the words underscored would indicate the additions to Section 8.01. Section 8.01 Terms and Qualifications Any elector resident of the City may be a candidate for and if elected may serve on the Charter Board as long as he is an elector of the City. SECTION 2 -.Each section. shall be considered separately and each question approved by a majority of the voters of the City of Tamarac at the November 4, 1980 election shall be effective as an amendment to the City Charter upon certification by the Broward County Canvassing Board and acceptance of the certification by the City Council. SECTION 3: Should any section or provision of this ordinance or any portion hereof or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as.a whole or any part hereof other than the part declared to be invalid. -2- !. is ' 1 2 3 4 5 6 8 9 10 11 12 13 14 15 16 17 9 20 21 22 23 24 25 26 27 28 29 a0 :L 32 33 34 35 36 G SECTION 4: This.ordinance shall become effective immediately upon it adoption, and the appropriate City officials are authorized to take whatever actions are necessary to see that these matters are placed on the November 4, 1980, ballot.
