CITY OF TAMARAC, FLORIDA
ORDINANCE NO. Q- F-O- &
AN ORDINANCE ESTABLISHING A FEE FOR CONSIDERATION OF
REQUESTS TO VACATE OR PARTIALLY VACATE EASEMENTS OR
RIGHTS -OF -WAY IN AN AMOUNT DETERMINED BY RESOLUTION
OF THE CITY COUNCIL; PROVIDING FOR CODIFICATION; PRO-
VIDING REPEALER; PROVIDING FOR SEVERABILITY OF INVALID
PROVISIONS AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, there are frequent applications made by property owners
to the City Council to vacate all or a portion of easements granted to the
public and rights -of -way; and
WHEREAS, processing and consideration of these requests cost the
City of Tamarac a substantial amount of time and money; and
WHEREAS, it is appropriate for the costs of processing to be borne
by the applicant.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF -THE CITY C,
TAMARAC, FLORIDA:
SECTION 1: A11_ applications for vacation or partial vacati.-o.n of. all or
a portion of public easements or rights -of -way shall be accompanied by a fee
in an amount determined by resolution of the City Council to cover the costs
of processing such requests. In addition, the applicant shall be responsible
for the reasonable costs of publication if any publication is required by
applicable regulations.

SECTION 2: Specific authority is hereby granted to codify this
SECTION 3: Should any section or provision of this ordinance or
any portion hereof or any paragraph, sentence or word be declared by a Court,
of competent jurisdiction to be invalid, such decision shall not affect the
validity of the remainder hereof as a whole or any part hereof other than the
part delcared to be invalid.
SECTION 4: All ordinances or parts of ordinances in conflict
herewith are repealed to the extent of such conflict.
SECTION 5: This ordinance shall become effective immediately upon
its final passage.
