ORDINANCE NO. O- ?d -- 9
AN ORDINANCE AMENDING SECTION 41 OF ORDINANCE NO.
72-29 ESTABLISHING A LOCAL OCCUPATIONAL LICENSE
TAX BY INCREASING THE OCCUPATIONAL LICENSE TAX,
AND BY AMENDING SECTION 1.4--23 OF THE CITY CODE
WHICH PROVIDES A PENALTY FOR LATE PAYMENTS BY IN-
CREASING SAID PENALTY, AND BY IMPOSING A PENALTY
FOR ENGAGING IN OR MANAGING ANY BUSINESS, OCCUPATION
OR PROFESSION WITHOUT FIRST OBTAINING AN OCCUPATIONAL
LICENSE; PROVIDING THAT SAID PENALTIES ARE IN
ADDITION TO PENALTIES SET FORTH IN SECTION 14-9 OF
THE CITY CODE; PROVIDING REPEALER; PROVIDING FOR
SEVERABILITY OR INVALID PROVISIONS; AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, Municipalities have been prohibited by the Florida
Legislature from increasing local Occupational License Taxes
since 1971; and
WHEREAS, the Truth in Millage Act enacted by the 1980
session of the Florida Legislature permits increases in local
Occupational Licenses Taxes; and
WHEREAS, the Tamarac City Council desires to increase Local
Occupational License Taxes,

NOW, THEREFORE, BE IT ORDAINED,BY THE CITY COUNCIL OF THE CITY
OF TAMARAC, FLORIDA:
SECTION 1: Section 41 of Ordinance No. 72-29 is -amended
by adding the numbers underscored as follows:

Licenses shall be issued to cover but one location and but one
of the occupations of busines.5 classifications. hereinafter set out
unless permitted hereunder, and the amounts assessed a!�. license taxes
against the various trades, businesses and professions are hereby fixed
as follows:
(1) Abstracting, land title, w.arrenty or security company.
Each.individual, firm, corporation or company
conducting the business of abstracting titles
either in part or in whole, shall pay a license

(2) Adding Machines, dictaphones, typewriters and the

(3) Advertising. (a) Agencies, firms, associations,
corporations, or other persons distributing cir-

this paragraph no existing license shall be
renewed by the City of Tamarac until the
,license holder shall have complied with the
provisions of this ordinance, but an appli-
cation hereunder need be made only once by
any applicant. The City Council may revoke
any license hereunder, after a public
hearing, if the license holder has violated
this subsection or been convicted of any
ordinance violation or crime involving
moral turpitude.

Sec. 42. LICENSE FEE WHERE NOT OTHERWISE PROVIDED.
Every business, occupation, profession, or exhibition, sub-
stantial, fixed or temporary, engaged in by any person, whether
in a building, tent, or upon the street, vacant lot or anywhere
in the open air, within the City not reasonably similar to
a designated classification or not specifically designated
in this Ordinance, shall pay a license fee of �t-y-F'3�

(a) Those licenses not renewed by October 1 shall ha rnnc;riera.a
delinquent and subject to a delinquency enalt of 10 percent for
the month of October, Plus an additional 5 2ercent-penalty for each
month of delin uenc thereafter until Paid. However, the total
delinquencX penaltyshall not exceed 25 Percent of the Occupational
License fee for the delinquent establishment.
(b) The penalties hereby imposed shall be collected in additon
to the amount of the license tax, and the payment of such penalties
shall not•be pleaded as a bar to any proceeding charging the offense
of doing business without a license under this chapter.

(c) Any"person.engaging in or mana in an business
occupation, or
a local occupational
license, if.re uired hereunder, shall be subject to a Penalty of
25 percent of the license determined to be due, in addition to an
)rofession without first obtaininc
other penalty Drovided by law or ordinance.
SECTION 3: That Article VIII Insurers is amended to comply witk�.�
Chapter 624.507 of the Florida Statute, as amended from time to time.
SECTION 4: Specific authority is hereby granted to codify the
amendment to Section 14-23 and Article VIII.
SECTION 5:
All ordinances or parts of ordinances in conflict
herewith are repealed to the extent of such conflict.
SECTION 6: Should any section or provision of this ordinance
or any protion hereof or any paragraph, sentence or word be declared
by a court of competent jurisdiction to be invalid, such decision

shall not affect the validity of the remainder hereof as a whole
or any part hereof other than the part declared to be invalid.
SECTION 7: This Ordinance shall become effective on
October 1, 1980. License taxes imposed for fiscal year 1980-81
will be based on taxes adopted herein.
