Ord. #1301 1 2 3. 4 7 8 9 10 11 12 13 14 15 16 _d 19 20 21 22 23 24 25 `.6 27 28 29 w_ 32 33 34 35 CITY OF TAMARAC, FLORIDA ORDINANCE No. 0-817 AN ORDINANCE AMENDING CHAPTER 7 OF THE CODE OF ORDINANCES OF THE CITY OF TAMARAC PERTAIN- ING TO CITY COUNCIL REVIEW OF FINAL SITE DEVELOPMENT PLANS; AMENDING SUBSECTION 7-7(D)(16) REQUIRING THAT CHECKS HELD AT THE DEVELOPER'S REQUEST SHALL BE HELD IN ESCROW BY THE FINANCE DIRECTOR, OR HIS DESIGNEE; PROVIDING FOR CODIFICATION; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; AND A FF T E DATE WHEREAS, a public hearing has been held pursuant to Chapter 166, Florida Statutes; and WHEREAS, the City Council of the City of Tamarac deter- mines that it is in the public interest to adopt the follow- ing Ordinance. WHEREAS, the City Council has determined that it would be more efficient for the Finance Department to handle the disposition of all checks provided to the City of Tamarac pursuant to Subsection 7-7(D)(16) of the Code of Ordinances. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1 That Subsection 7-7 (D) (16) is hereby amended to read as follows: D. City Council Review. The city planner shall transmit the documents outlined below to the city council for review. In no case shall the petition be placed on a council agenda for council consider- ation until all necessary documents have been submitted in acceptance form and council has had at least five (5) working days before a council meeting to review the documents. (16) Indication of payment of all fees required to have been paid by the time of site plan approval. At the developer's request, a check may be held in escrow by the <e!4y-at*_efney_> a c __djjgctor , or his de5ianeg, and not deposited unless and until the final site plan is approved by the council. -1- Temp. SECTIQN_ : All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. BECTION_ 4: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be sever- able. ,5ECTION_5: This Ordinance shall become effective immediately upon adoption and passage.
