AN ORDINANCE AUTHORIZING AND DIRECTING THE
PROPER CITY OFFICIALS TO CONDUCT A
REFERENDUM ELECTION ON TUESDAY, MARCH 10,
1987, TO PROPOSE AN AMENDMENT TO SECTION
4.06 OF THE CITY CHARTER PROVIDING FOR CITY
COUNCIL MEETINGS; AMENDING SUB -SECTION
4.06(a) TO ALLOW THE CITY COUNCIL TO
DETERMINE THE FOUR (4) WEEK PERIOD IN WHICH
IT IS NOT TO MEET AS OPPOSED TO NOT MEETING
IN AUGUST AS CURRENTLY REQUIRED; PROVIDING
THAT IF A MAJORITY OF THE VOTERS APPROVE THE
PROPOSED AMENDMENT THEN IT SHALL BECOME AN
AMENDMENT TO THE CHARTER OF THE CITY OF
TAMARAC UPON CERTIFICATION AND ACCEPTANCE OF
THE ELECTION RESULTS; PROVIDING FOR SEVER -
ABILITY OF INVALID PROVISIONS PROVIDING FOR
CODIFICATION; PROVIDING FOR THE APPROPRIATE
CITY OFFICIALS TO ENSURE PLACB1.*,N.1 ON THE
BALLOT, AND FRPV-_DI,N-G ,AN --EFFECT TE
WHEREAS, due to the budget process set forth in State
Statutes, the City Council of the City of Tamarac has deter-
mined that it should meet curing the month of August; and
WHEREAS, the City Charter currently requires that the
City Council to be recessed during the month of August.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF TAMARAC, FLORIDA.
SECTION 1: That the following proposed Amendment is to
be presented to the Electorate of the City of Tamarac at the
March 10, 1987 election and that the proposed Amendment if
approved by a majority of the electorate at said election the
approved proposed Amendment shall become an Amendment to the
City Charter upon certification and acceptance of the
election results by the City Council:

Sub -section 4.06(a) providing that the City Council shall
determine the four week period in which it is not to meet as
opposed to not r,!eeting in August as currently required.

If this proposed Amendment is approved, the words that
are F will indicate the deletions and the
underscored words will indicate the new language.
Section 4.06 Procedures.
(a) Meetings. The council shall meet regularly at
least twice a month, except during <-Attj> a four (4)
consecutive week period to be determined by the City Council
no later than April 15 of each year at such times and places
as the council may decide. Special meetings may be held on
the call of the mayor or of a majority of the members upon no
less than twelve (12) hours' notice to each member. In the
event of an emergency, the mayor may call for an immediate
meeting of the council.
(b) Rules and Journal. the council shall determine its
own rules and order of business, and shall keep minutes of
its proceedings.
(c) Voting and Quorum. voting on ordinances and
resolutions shall be by roll call and each vote shall be
recorded in the journal. A majority of the council will
constitute a quorum. An affirmative vote of three (3)
members shall be necessary to enact any ordinance or adopt
any resolution.
SECTION 2: Should any section or provision of this
Ordinance or any portion hereof or any paragraph, sentence or
word be declared by a Court of competent jurisdiction to be
invalid, such decision shall not affect the validity of the
remainder hereof as a whole or any part hereof other than the
part declared to be invalid.
SECTION 3: Specific authority is hereby granted to
codify the change to Section 4.06 of the City Charter if
approved by the electorate.
SECTION 4: That the appropriate City officials are
authorized to take whatever actions are necessary to ensure
that these matters are placed on the March 10, 1987 ballot.

Attached please find the above cited Ordinance which is
to be placed on the Council agenda in order that it is timely
forwarded to the Supervisor of Elections. By carbon copy of
this memorandum to the Mayor and Council, I am advising that
the proposed amendment will allow the City Council to
determine when it should be recessed. By not meeting in
August, the budget process is delayed to some extent. This
will further ensure that all Council members are present
during the time when important budget decisions are being
made.
